202401002 <br />as evidenced by said Borrower's Promissory Note dated 13 -07 , 2024, payable according <br />to the terms thereof. <br />This security instrument secures to Lender each and all of the following: (a) the debt <br />evidenced by the above-mentioned Promissory Note, with interest (if any), together with <br />all extensions, renewals, modifications, and/or substitutions, (b) all future advances from <br />Lender to Borrower or other future obligations of Borrower to Lender under any <br />promissory note, contract, guaranty, or other evidence of debt existing now or executed <br />after this Deed of Trust, whether or not this Deed of Trust is specifically referenced to in <br />the evidence of debt, (c) all other obligations of Borrower to Lender, which may now exist <br />or may later arise, to the extent not prohibited by law, (d) all additional sums advanced <br />and expenses incurred by Lender for insuring, preserving, or otherwise protecting the <br />property which is the subject of this Deed of Trust and its value, and any other sums <br />advanced and expenses incurred by Lender under the terms of this Deed of Trust <br />including, but not limited to, trustee's fees, attorneys fees, property taxes, and other costs <br />and expenses relating thereto. <br />If more than one person signs this Deed of Trust as Borrower, each Borrower agrees that <br />this Deed of Trust will secure all obligations described above that are incurred by any <br />one or more Borrower, or by any one or more Borrower and others. <br />Borrower covenants that Borrower is lawfully seized of such real estate and has the legal <br />power and lawful authority to convey the same and warrants and will defend title to the <br />real estate against the lawful claims of all persons. <br />BORROWER AND LENDER HEREBY AGREE AS FOLLOWS: <br />1. 2023 NEBRASKA AFFORDABLE HOUSING TRUST FUND GRANT <br />("NAHFT"). Borrower has secured funding from the 2023 Nebraska Affordable Housing <br />Trust Fund Grant (Award Contract Number 23-TFRH-34010). Borrower agrees to <br />remain current and compliant with all obligations, conditions, and responsibilities <br />demanded of Borrower under the NAHTF. <br />2. PAYMENTS. In lieu of monetary payments, Borrower shall remain current <br />with, and in compliance of, the terms of the 2023 NAHTF program. So long as Borrower <br />remains in compliance with the 2023 NAHTF program, no payments shall be required. <br />3. LIENS OR ENCUMBRANCES AGAINST PROPERTY. In no event shall <br />Borrower allow or cause to allow a lien or encumbrance to attach to or to be placed on or <br />against the property without the express written permission of the Lender. In the event <br />that Borrower is in violation or default of this section, Lender shall be entitled to the <br />same remedies as those set forth in Paragraph "4. OTHER LIENS." <br />4. OTHER LIENS. In no event shall Borrower cause or agree to cause to <br />attach to the Property any lien or encumbrance which has or may attain priority over <br />this security instrument.
