Wheeler Avenue <br />Grand Island, NE 68801 <br />DECLARATION <br />OF <br />CONESTOGA NORTH BUSINESS CONDOMINIUMS <br />The undersigned Declarants create a condominium in the manner established by the <br />Nebraska Condominium Act. <br />1. Names. The name of the condominium is "CONESTOGA NORTH BUSINESS <br />CONDOMINIUMS." The name of the association is "CONESTOGA NORTH BUSINESS <br />CONDOMINIUMS UNIT OWNERS ASSOCIATION, INC.", a nonprofit corporation <br />("association"). <br />2. Description. The condominium is situated in Hall County, Nebraska on the <br />following -described real estate: <br />Lot 1, Conestoga North Twelve Subdivision, in the City of Grand Island, Hall <br />County, Nebraska; and <br />Lot 8 and Lot 9, Conestoga North Subdivision, in the City of Grand Island, Hall <br />County, Nebraska. <br />3. Number of Units. The number of units to be initially created is Three (3), but the <br />number of units may increase in accordance with the provisions of this Declaration. <br />4. Boundaries. The boundaries of each unit, including the unit's identifying number, <br />are shown on Exhibit "A" (plat and plan). <br />5. Common Elements. The common elements are all portions of the condominium <br />other than the units. <br />6. Allocated Interests. The allocated interests have been established based upon a <br />formula utilizing the number of units in the condominium and it is hereby declared that all such <br />interests shall be allocated in the following manner: <br />(a) Voting. Each unit shall be entitled to one (1) vote in the conduct of the <br />condominium through the association. <br />(b) Common Expense Liability. Each unit shall be responsible for and shall <br />be assessed for all common expenses incurred by the association, based upon the <br />square footage of each condominium unit located within a building, as a percentage <br />of the total square footage of the units located within a building of the condominium <br />as follows: <br />Unit One (l) 57.12% <br />Unit Two (2) 32.26% <br />Unit Three (3) 10.62% <br />
