The parties share a common two car garage, part located on Lot A and part located on Lot B, and a common driveway leading up to the garage, also located part on Lot A and part on Lot B. Based upon the foregoing and consideration of mutual covenants and promises herein the parties agree as follows: 1 . The parties hereby grant to each other the right to use that portion of the shared driveway which exists on the other party's real estate. 2. That the common wall of the garage shall be considered a party wall and the parties shall have the right to use it jointly. 3. If it becomes necessary or desirable to repair or rebuild the whole or any part of the wall, the repairing or rebuilding expense shall be born equally by the parties or their heirs and assigns. Any repairing or rebuilding of the wall shall be on the same location and of the same size as the original wall or a portion thereof, and of the same or similar material and of the same quality as that used in the original wall or portion thereof. 4. However, each party shall be responsible for repairing and maintaining their respective portion of the garage.
