The parties share a common two car garage, part located on Lot A and part <br />located on Lot B, and a common driveway leading up to the garage, also located part <br />on Lot A and part on Lot B. Based upon the foregoing and consideration of mutual <br />covenants and promises herein the parties agree as follows: <br />1 . The parties hereby grant to each other the right to use that portion of the <br />shared driveway which exists on the other party's real estate. <br />2. That the common wall of the garage shall be considered a party wall and the <br />parties shall have the right to use it jointly. <br />3. If it becomes necessary or desirable to repair or rebuild the whole or any part <br />of the wall, the repairing or rebuilding expense shall be born equally by the parties or <br />their heirs and assigns. Any repairing or rebuilding of the wall shall be on the same <br />location and of the same size as the original wall or a portion thereof, and of the same <br />or similar material and of the same quality as that used in the original wall or portion <br />thereof. <br />4. However, each party shall be responsible for repairing and maintaining their <br />respective portion of the garage.
