<br />Contractor: A building contractor satisfactory to American Family to complete
<br />the Work.
<br />Coupon Rate: A rate of interest of Eight and Two One Hundredths percent
<br />(8.02%) per year.
<br />Default Rate: An annual rate equal to the lesser of: (i) the maximum rate
<br />permitted by applicable law; or (ii) the greater of (a) five percent (5 %) above the Coupon Rate
<br />or (b) five percent (5 %) above the Index Rate in effect at the time of the occurrence of an Event
<br />of Default.
<br />Disabilities Regulations: The act entitled Americans with Disabilities Act of 1990,
<br />42 U.S.C. Section 12101, et seq., all amendments thereto and reauthorizations thereof, and all
<br />regulations, orders, rules, policies, and rules of common law promulgated or arising in connection
<br />therewith.
<br />Environmental Indemnity: The Loan Document entitled Environmental
<br />Indemnity Agreement by which Borrower and Guarantor, jointly and severally as indemnitors,
<br />agree to hold American Family harmless from, and to indemnify American Family against, and
<br />to reimburse American Family for, any and all losses, claims, liabilities, damages (including
<br />compensatory, consequential and punitive), injunctive relief, injuries to person, property or
<br />natural resources, costs, expenses (including reasonable attorneys' and paralegals' fees and costs),
<br />actions or causes of action, arising from or in connection with:
<br />(a) the spill, leakage, emission, presence, release or threatened release
<br />of any Hazardous Substance at the Real Estate;
<br />(b) any obligation or liability arising under, or violation of, any
<br />Environmental Law with respect to the Real Estate; or
<br />(c) any obligation or liability arising under any Environmental Law
<br />with respect to any Hazardous Substance at any offsite location which migrated or was
<br />transported from, or is alleged to have migrated or to have been transported from, the site of any
<br />parcel constituting the Real Estate.
<br />Environmental Law: Any applicable current or future federal, state or local law,
<br />statute, regulation, order, rule or policy, or rule of common law, which regulates or affects
<br />environmental, health or safety matters, including, without limitation, those relating to: (i) the
<br />treatment, storage, disposal, generation and transportation of any Hazardous Substance; (ii) air,
<br />soil, water, electromagnetic or noise emissions or pollution; (iii) surface or ground water
<br />contamination; (iv) spills, discharges, leaks, emissions, escapes, dumping or other releases or
<br />threatened releases of any Hazardous Substance into the environment, whether or not notification
<br />or reporting to any governmental agency was or is required; (v) the protection of wildlife, marine
