2000.1180 <br />(b) No provision of this Trust Deed shall require Trustee to expend or <br />risk its own funds, or otherwise incur any financial obligation in the performance of any of its <br />duties hereunder, or in the exercise of any of its right or powers, if it shall have grounds for <br />believing that the repayment of such funds or adequate indemnity against such risk or liability is <br />not reasonably assured to it. <br />(c) Trustee shall not be liable for any action taken by it in good faith <br />and reasonably believed by it to be authorized or within the discretion, rights, and powers <br />conferred upon it by this Trust Deed and the Act. <br />(d) Trustee may resign at any time without cause. <br />(e) Any person, including American Family, may become a purchaser <br />at any sale or the Trust Estate, whether judicial or under the power of sale granted herein. <br />Trustee may postpone any sale of all or any portion of the Trust Estate as provided in the Act, <br />and may sell the Trust Estate as a whole or in separate lots. <br />SECTION 9.2 APPOINTMENT OF SUCCESSOR TRUSTEE. American <br />Family may, from time to time and in the manner provided by the Act, appoint a successor or <br />successors to the Trustee named herein or acting hereunder. <br />SECTION 9.3 RECONVEYANCE OF TRUST ESTATE BY TRUSTEE. <br />This Trust Deed shall continue in full force and effect from the date hereof until the Trust Estate <br />is reconveyed as provided herein. Upon written certification by the Beneficiary to the Trustee <br />that the entire Indebtedness has been paid and that all obligations under covenants and agreements <br />of Borrower hereunder that are secured by this Trust Deed are performed, Trustee shall <br />reconvey to Borrower, or to the person or persons legally entitled thereto, without warranty, any <br />portion of the Trust Estate then held hereunder in the manner provided by the Act. The grantee <br />in any such reconveyance may be described as "the person or persons legally entitled thereto." <br />Such person or persons shall pay any costs of the reconveyance, including any recording costs. <br />The Beneficiary and the Trustee are directed to deliver the reconveyance instruments to <br />Borrower for recording. <br />ARTICLE 10 <br />MISCELLANEOUS <br />SECTION 10.1 CHOICE OF LAW. This Trust Deed is made under the <br />laws of the State of Nebraska and is intended to be governed by the internal laws of the State of <br />Nebraska. <br />44 <br />
