<br />NORTHWEST CROSSINGS LIMITED LIABILITY COMPANY, a Nebraska limited
<br />liability company, herein called the Grantor, in consideration of the sum of One Dollar
<br />($1.00), receipt of which is hereby acknowledged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called the Grantee, a permanent
<br />and perpetual easement and right-of-way to survey, construct, inspect, maintain, repair,
<br />replace, relocate, extend, remove, and operate thereon, public utilities and
<br />appurtenances connected therewith, in, upon, above, along, over, across, underneath,
<br />and through a part of the Southeast Quarter of the Southeast Quarter (SE1/4, SE1/4), of
<br />Section One (1), Township Eleven (11) North, Range Ten (10) West of the 6th PM, in the
<br />City of Grand Island, Hall County, Nebraska; the boundary of the twenty (20.0) foot wide
<br />utility easement and right-of-way tract being more particularly described as follows:
<br />Commencing at the Southeast corner of the Southeast Quarter of the
<br />Southeast Quarter (SE1/4, SE1/4), of Section One (1), Township Eleven
<br />(11) North, Range Ten (10) West of the 6th PM, in the City of Grand Island,
<br />Hall County, Nebraska; thence westerly along the southerly line of the
<br />Southeast Quarter of the Southeast Quarter (SE1/4 SE1/4), of said Section
<br />One (1), on an assumed bearing of N89°53'32"W, a distance of two hundred
<br />sixty-four and forty-seven hundredths (264.47) feet; thence N0°25'00"W, a
<br />distance of forty and forty-one hundredths (40.41) feet to a point on the
<br />northerly right-of-way line of Capital Avenue, said point also being the
<br />ACTUAL Point of Beginning; thence continuing N0°25'00"W along the
