202302402 <br />outside of the private patio or areas approved by the Association. <br />VIII. Insurance: <br />Section 1. Basic Coverage. Insurance policies upon the common area improvement, <br />including the common area lighting, well, pump and sign, shall be purchased by and in the name of <br />the Association for the benefit of the Association and the Owners as their interests may appear. The <br />Association shall provide casualty insurance coverage for each villa up to an amount of $250.00 per <br />square foot. Any Owner desiring coverage in a greater amount reserves the right to purchase any <br />supplemental policy at the Owner's expense. The Association may from time -to -time review existing <br />policies and adopt changes, including but not limited to additional coverage as deemed necessary. <br />IX. Access <br />The Association, its employees and agents, shall have the right to go on any lot or into or upon <br />any dwelling or any lot in the Properties for the purposes of performing maintenance and repair, <br />making inspections, and insuring compliance by each Owner with the duties of the Owner hereunder, <br />and is hereby granted a specific easement for such purpose, but, except for emergencies or with the <br />Owner's consent, no dwelling shall be entered except during daylight hours and following reasonable <br />notice to the Owner or occupant thereof. <br />X. General Provisions. <br />Section 1. Enforcement. The Association, or any Owner, shall have the right to enforce <br />by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens, and <br />charges now or hereafter imposed by the provisions of this Declaration. Failure by the Association <br />or by any Owner to enforce any covenants or restrictions herein contained shall in no event be deemed <br />a waiver of the right to do so thereafter. <br />Section 2. Severability. Invalidation of any one of these covenants or restrictions by <br />judgment or court order shall in no way affect any other provisions which shall remain in full force <br />and effect. <br />Section 3. Amendment. This Amendment Declaration shall run with and bind the <br />property from the date this Declaration is recorded. This Declaration may be amended by an <br />instrument signed by the Owners of not less than sixty percent (60%) of the lots. Any amendment <br />must be recorded. <br />Section 4. Transfer of Ownership. It is the obligation of the homeowner selling a unit to <br />provide the Realtor or the seller a copy of this Amendment of Declaration. <br />Paragraph 3 of Exhibit "B" to the Regime 1 Declaration and the Regime II Declaration is <br />hereby deleted. <br />In the event any provision of this Amendment of Declaration conflicts with the Regime 1 <br />Declaration, the Regime II Declaration or the Bylaws of the Fairway Villas Homeowners <br />Association, it is the intention of the signatories hereto that the Amendment of Declaration shall <br />prevail.
