Locust Street Ste. 501 <br />Grand Island, NE 68801 <br />- - --------- <br />REFUNDS: <br />CASH <br />CHECK <br />HALL::: <br />2023 t <br />7( NE <br />! 9 <br />RE: Villa Nos. 1-11, Fairway Villas Condominium Property Regime I, Grand Island, Hall / <br />County, Nebraska <br />SECOND AMENDMENT OF DECLARATION <br />WHEREAS, the "Master Deed Creating Fairway Villas Condominium Property Regime I" <br />was recorded at the Hall County Register of Deeds as Document Number 80-00742 on December 4, <br />1980, establishing Villas 1 through 6 of Fairway Villas, and subsequently amended by an <br />"Amendment to Master Deed and Declaration" recorded at the Hall County Register of Deeds as <br />Document Number 0201008673 on November 22, 2010, (collectively the "Regime I Declaration"); <br />and <br />WHEREAS, the "Master Deed Creating Fairway Villas Condominium Property Regime II" <br />was recorded at the Hall County Register of Deeds as Document Number 81-003276 on June 23, <br />1981, and subsequently amended by an "Amendment to Master Deed and Declaration" recorded at <br />the Hall County Register of Deeds as Document Number 0201008674 on November 22, 2010 <br />(collectively the "Regime II Declaration"); and <br />WHEREAS, the Fairway Vilas Homeowner's Association (the "Association") wishes to <br />make certain changes to the Regime I Declaration and the Regime II Declaration; and <br />WHEREAS, the Association wishes to consolidate the Regime I Declaration and the <br />Regime II by this Second Amendment of Declaration (the "Amendment"); and <br />WHEREAS, all owners of property in governed by the Regime 1 Declaration and the <br />Regime II Declaration (the "Owners") approved said changes recommended by the Association. <br />NOW, THEREFORE, the undersigned Owners hereby adopt the Amendment of <br />Declaration, which is for the purpose of protecting the value and desirability of each of the <br />foregoing, and which shall run with the land and be binding on all parties having any right, title <br />or interest in any of the Property, their heirs, successors and assigns. <br />I. Involved Property: This Amendment shall be binding on all property set forth in the <br />Regime I Declaration and the Regime II Declaration. <br />II. Definitions: The following definitions shall apply to this Amendment: <br />a. "Villa" shall mean and include: The enclosed space of the residential living units <br />and enclosed garages; first and second story patios, all airspace in rooms; attics; <br />air conditioning compressors or units; permanent gas, charcoal burning or electric <br />barbecue grills, screening, window glass, exterior and interior doors; roofs above <br />each unit; but shall not include structural walls, common walls, interior walls, <br />floors and ceilings, except for the unit -side surfaces thereof, which shall be <br />included in the definition Villa. <br />b. "Condominium" shall mean the entire condominium project, including all <br />buildings, land and, and other improvements upon the land as set forth in this <br />
