202301743
i. Secured Creditors. The Plaintiff shall assume the debt through
Centris Bank on the 2012 GMC Sierra as his individual debt and shall hold the
Defendant harmless therefrom. The Plaintiff shall assume the debt through First
Premier Bank on the 2012 Keystone Camper as his individual debt and shall hold
the Defendant harmless therefrom. The Defendant shall assume the debt through
Centris Bank on the 2012 Toyota Highlander as her individual debt and shall hold
the Plaintiff harmless therefrom.
j. Unsecured Creditors. The Plaintiff shall assume the debts listed in
J-2 through J-3, and J-13 through J-16 of Exhibit 7 as his individual debt and shall
hold the Defendant harmless therefrom. The Defendant shall assume the debts
listed in J-1 and J-4 through J-11 of Exhibit 7 as her individual debt and shall hold
the Plaintiff harmless therefrom.
k. Premarital Assets. There was no credible testimony to establish
the existence of any premarital assets by either party.
1. Premarital Debts. There was no credible testimony to establish the
existence of any premarital debts by either party.
m. Gifted or Inherited Property. There was no credible testimony to
establish the existence of any gifted or inherited property by either party.
No further payment is due from either party to equalize the distribution of
marital debts and assets. The distribution of assets and debts falls within the
requirements of the property division of the marital estate. Further and as noted
previously, the Plaintiff provided multiple items of duplication and did not meet his
burden in establishing items of property and the respective value. The Court's
distribution of the assets and debts is fair and reasonable based on the testimony
and evidence in this matter.
VI.
Each party shall be responsible for any and all debt incurred by him or her
since the date of separation, that date being July 23, 2020, and not specifically
allocated in the property division. Each party shall keep any property currently in
his or her possession and not specifically allocated in the property division. Each
party shall keep any property owned by him or her prior to the marriage and shall
pay any debts owed by him or her prior to the marriage.
Page S of
8
