202301132 <br />February 28, 2023 <br />Resolution Vacating 140th Road <br />South of Interstate 80 <br />Page 2 of 3 <br />WHEREAS, Michael Gloe of Wood River, Nebraska testified in favor and no one spoke in <br />opposition to the vacation of the above portion of 140th Road; and <br />WHEREAS, the Hall County Board of Commissioners acting in accordance with Neb. Rev. Stat. <br />§ 39-1725 find that: <br />• Hall County is not operating roads on a township basis. <br />• The only roads users are abutting property owners for access to their property. <br />• There is no apparent benefit to the travelling public for the road to remain open. <br />• This section of road only serves adjacent properties. <br />• 140th Road does not continue south of the Platte River. <br />• The road is not a school bus route or mail route. <br />• Vacating said road will not land lock any parcels. <br />• There are no occupied dwellings that use this section of road. <br />• No access is being reasonably denied to anybody by vacating this section of road. <br />• There is no future anticipated need for this section to be a public road. <br />• The road is not located within the zoning jurisdiction of a city first class. <br />NOW THEREFORE BE IT RESOLVED, that the public road named as 140th Road south of <br />Interstate 80 in Hall County, Nebraska commencing at a point on the west line of Section Eighteen <br />(18), Township Nine (9) North, Range Eleven (11) West of the 6th P.M., Hall County, Nebraska, <br />said point being One Thousand One Hundred Seventy Four and Thirty Two Hundredths <br />(1,174.32) feet south of the Northwest Corner of said Section 18, and also being on the east line <br />of Section Thirteen (13), Township Nine (9) North, Range Twelve (12) West) of the 6th P.M. Hall <br />County Nebraska and said point also being One Thousand One Hundred Seventy Four and Thirty <br />Two Hundredths (1,174.32) feet south of the Northeast Corner of said Section 13, thence <br />extending southerly on the line between said Sections 18 and 13 to the Platte River where the <br />vacation ends, more particularly described as: <br />All that part of the westerly Thirty Three (33.00) feet of Government Lot One (1) and that <br />part of the Northeast Quarter (NE1/4) lying south of Interstate 80 right-of-way in Section <br />Eighteen (18), Township Nine (9) North, Range Eleven (11) West and all that part of the <br />easterly Thirty Three (33.00) feet of Government Lot Four (4) and Government Lot Five <br />(5) lying south of Interstate 80 right-of-way in Section Thirteen (13), Township Nine (9) <br />North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska. <br />Is hereby vacated, effective the date of this resolution, with the right-of-way (as shown on the <br />attached plat) reverting to the adjacent real estate, in accordance with Neb.
