202301132 February 28, 2023 Resolution Vacating 140th Road South of Interstate 80 Page 2 of 3 WHEREAS, Michael Gloe of Wood River, Nebraska testified in favor and no one spoke in opposition to the vacation of the above portion of 140th Road; and WHEREAS, the Hall County Board of Commissioners acting in accordance with Neb. Rev. Stat. § 39-1725 find that: • Hall County is not operating roads on a township basis. • The only roads users are abutting property owners for access to their property. • There is no apparent benefit to the travelling public for the road to remain open. • This section of road only serves adjacent properties. • 140th Road does not continue south of the Platte River. • The road is not a school bus route or mail route. • Vacating said road will not land lock any parcels. • There are no occupied dwellings that use this section of road. • No access is being reasonably denied to anybody by vacating this section of road. • There is no future anticipated need for this section to be a public road. • The road is not located within the zoning jurisdiction of a city first class. NOW THEREFORE BE IT RESOLVED, that the public road named as 140th Road south of Interstate 80 in Hall County, Nebraska commencing at a point on the west line of Section Eighteen (18), Township Nine (9) North, Range Eleven (11) West of the 6th P.M., Hall County, Nebraska, said point being One Thousand One Hundred Seventy Four and Thirty Two Hundredths (1,174.32) feet south of the Northwest Corner of said Section 18, and also being on the east line of Section Thirteen (13), Township Nine (9) North, Range Twelve (12) West) of the 6th P.M. Hall County Nebraska and said point also being One Thousand One Hundred Seventy Four and Thirty Two Hundredths (1,174.32) feet south of the Northeast Corner of said Section 13, thence extending southerly on the line between said Sections 18 and 13 to the Platte River where the vacation ends, more particularly described as: All that part of the westerly Thirty Three (33.00) feet of Government Lot One (1) and that part of the Northeast Quarter (NE1/4) lying south of Interstate 80 right-of-way in Section Eighteen (18), Township Nine (9) North, Range Eleven (11) West and all that part of the easterly Thirty Three (33.00) feet of Government Lot Four (4) and Government Lot Five (5) lying south of Interstate 80 right-of-way in Section Thirteen (13), Township Nine (9) North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska. Is hereby vacated, effective the date of this resolution, with the right-of-way (as shown on the attached plat) reverting to the adjacent real estate, in accordance with Neb. Rev. Stat. § 39-1725,.
