202301132 RESOLUTION # 2023- n ( 7 RESOLUTION VACATING A PORTION OF 140TH ROAD SOUTH OF INTERSTATE 80 WHEREAS, Michael Gloe presented a petition to the Hall County Board of Commissioners requesting vacation or abandonment of approximately 1,900 feet of 140th Road south of the Nebraska Department of Transportation's Interstate 80 right-of-way at the December 5, 2023 meeting; and WHEREAS, the Hall County Board of Commissio ers and the Office of the Hall County Clerk received the above petition on December 20, 202nd WHEREAS the above petition was properly filed in accordance to Neb. Rev. Stat. § 39-1723; and WHEREAS, in accordance with Neb. Rev. Stat. § 39-1722, Resolution number was passed by the Hall County Board of Commissioners on December 20, 2023, directing the Hall County Highway Superintendent to study the use being made of the public road named as 140th Road south of Interstate 80; and WHEREAS, pursuant to such direction, the Hall County Highway Superintendent made a study of the uses of such road and submitted a report to the Hall County Board of Commissioners on January 17, 2023 with findings and a recommendation that 140th Road south of the public road right-of-way acquired for Interstate 80 southerly to the Platte River be vacated; and WHEREAS, the Hall County Board of Commissioners received the report from the Hall County Highway Superintendent on January 17, 2023 and passed Resolution number 23-003, in accordance to Neb. Rev. Stat. § 39-1724, scheduling a public hearing for 10:00 am on February 14, 2023 on the vacation of 140th Road south of Interstate 80 in Hall County, Nebraska; and WHEREAS, Resolution number 23-003 scheduling the public hearing was published in the Grand Island Independent on January 25th, February 4th and February 8th of 2023 , in accordance to Neb. Rev. Stat. § 39-1724; and WHEREAS, a Notice of Public Hearing was published in the Grand Island Independent on February 4, 2023 in accordance with Resolution number 23-003; and WHEREAS, copies of resolution number 23-003 scheduling the public hearing were served by certified mail upon the owners of land abutting on or adjacent to the road to be vacated on January 23, 2023 in accordance to Neb. Rev. Stat. § 39-1724; and WHEREAS, a copy of the resolution scheduling the public hearing was sent to the planning director of the Grand Island / Hall County Regional Planning Commission in accordance with Resolution number 23-003; and WHEREAS, at 10:00 A.M. on February 14, 2023 the Hall County Board of Commissioners, acting in accordance with Neb. Rev. Stat. § 39-1724, conducted a public hearing regarding the vacation of 140th Road south of Interstate 80 in Hall County, Nebraska in the county board room at 121 South Pine Street in Grand Island; and
