202300565 6. All construction and building activity shall be performed in compliance with all applicable building codes and ordinances of the City of Grand Island, Nebraska. 7. No sign of any kind shall be erected, placed or displayed on the Lot to advertise or promote any commercial activity or business. 8. No worn out or discarded automobiles, tires, machinery, or parts thereof, junk piles, or any hazardous materials or chemicals shall be stored on the Lot. 9. One (1) outbuilding and one (1) single family residence may be constructed on the Lot. No group home is permitted on the Lot. No multi -family dwellings, apartments, cooperatives, condominiums or townhomes are permitted. 10. If any of the Covenants herein set forth are declared void or unenforceable by a court of competent jurisdiction, the remaining Covenants shall not be affected, but shall stay and remain in full force and effect. 11. THE COVENANTS DO NOT RESTRICT THE DEVELOPMENT OF THE PROTECTED PROPERTIES IN ANY MANNER. 12. The Covenants shall run with the land and shall be binding on all persons and all parties claiming ownership of the Lot and the Protected Properties, successors, assigns and grantees, their heirs, devisees and personal representatives, until such time as terminated or released by ALL of the owners of the Lot and ALL of the owners of the Protected Properties. 13. If an owner of the Lot shall violate any of the Covenants, any owner of any part of the Protected Properties may enforce the Covenants and a violating party shall be responsible to pay all legal fees and court costs incurred in any enforcement action. 14. If any of the Covenants herein set forth are declared void or unenforceable by a court of competent jurisdiction, the remaining Covenants shall not be affected, but shall stay and remain in full force and effect.
