202300565 <br />DECLARATION OF COVENANTS AND RESTRICTIONS <br />THISF,,1C ,(RATION�^OF COVENANTS AND RESTRICTIONS (the "Covenants") is made <br />this day of TP y Q‘,AGv 2023 by Kenneth D. Caldwell and Pamela R. Caldwell, <br />husband and wife, and David L. CaldvJell, a single person. <br />KNOWN ALL MEN BY THESE PRESENTS: <br />I. <br />DESCRIPTION OF LAND <br />The land SUBJECT to the Covenants is legally described as: <br />Lot Two (2), Caldwell Subdivision, an Addition to the City of Grand Island, Hall <br />County, Nebraska (the "Lot"). <br />The land BENEFITED by the Covenants is legally described as: <br />Lots One (1) and Three (3), Caldwell Subdivision, an Addition to the City of <br />Grand Island, Hall County, Nebraska (the `Protected Properties"). <br />II. <br />DECLARATION OF PURPOSE <br />The purposes of the Covenants are: (i) to restrict development and improvement of the Lot, and <br />(ii) to preserve and protect the Protected Properties. <br />III. <br />COVENANTS AND RESTRICTIONS <br />The Lot shall be and is subject to the following covenants and restrictions: <br />1. Water shall not be discharged, pumped, channeled, directed or drained in any <br />manner to cause water to leave the boundaries of the Lot and drain onto or across <br />the Protected Properties. <br />2. The Lot shall not be subdivided or split to create additional lots without the prior <br />written consent of the owners of the Protected Properties, which written consent <br />shall be recorded with the Hall County Register of Deeds in order to be effective. <br />3. The Lot shall not be used for commercial, or business purposes, including, but not <br />limited to, horses, livestock, dogs, cats, pets, chickens, exotic animals or other <br />animals breeding, sales, kennels, or production. Subject to City Code <br />requirements one (1) shop or detached outbuilding building is permitted for <br />personal use. <br />4. No tower structures of any nature, including but not limited to, cell phone, <br />shortwave radio, or wind power generation are permitted on the Lot. Solar panels <br />are permitted only if affixed to the roof of the building being serviced. <br />5. No building or dwelling shall be moved onto the Lot. No pre -fab, modular, <br />manufactured or mobile home shall be placed on the Lot; no trailer, tent, garage, <br />shack or any other unsightly outbuilding shall be used as a dwelling at any time, <br />nor shall any structure of a temporary nature be used as a residence. <br />2 <br />
