202300159 <br />access points to and from any private road adjacent to or withing the <br />Property. <br />e) Water Facilities. All underground water lines, up to the point at which such <br />water lines enter a Unit, or the point at which a Unit's shutoff valve is <br />located, whichever is further from the Unit; underground sprinkler systems, <br />including lawn and landscape sprinkler systems now in existence or <br />installed in the future. <br />f) Primary Improvements. All roof, soffits, fascia, gutters, siding, external <br />garage doors, windows, and external doors. <br />g) Miscellaneous Improvements. All other improvements installed by the <br />Association within any utility easements, access easements, pedestrian <br />access easements, and/or landscaping easements. <br />3) Maintenance and Regulation of Common Elements. All Common Elements <br />shall be maintained, repaired and replaced, and snow removal services shall <br />be provided for, by the Association as necessary so that any such Common <br />Elements present an aesthetically attractive appearance, and/ or serve the <br />purpose for which such Improvements or facilities were installed, <br />4) Common Utilities. The Association shall charge each Unit Owner its allocated <br />share of the utilities for maintenance of the Common Elements, including but <br />not limited to, water, sewer, gas and electricity. <br />5) Unit Owner's Easements of Enjoyment. Each Unit Owner shall have a right and <br />easement of enjoyment in and to the Common Elements and such easement <br />shall be appurtenant to and shall pass with title to every Unit, subject to the <br />following provisions: <br />a) The right of the Association to promulgate and publish reasonable Rules and <br />Regulations as provided in this Declaration. <br />b) The right of the Association to close or limit use of the Common Elements <br />while maintaining, repairing and making replacements in or to the Common <br />Elements <br />6) Delegation of Use. Unit Owners may delegate their right of enjoyment to the <br />Common Elements and facilities, but not their voting rights, to their tenants or <br />contract purchasers who occupy the relevant Unit. <br />7) No Partition of Common Elements. The Common Elements are not subject to <br />partition, and any purported conveyance, encumbrance, judicial sale, or other <br />voluntary or involuntary transfer of an undivided interest in the Common <br />Elements made without the Unit to which that interest is allocated is void. <br />ARTICLE 7. LIMITED COMMON ELEMENTS <br />1) Limited Common Elements. Initially, there are no Limited Common Elements, <br />except as set forth in Nebraska Revised Statues §76-839(4). The Board of <br />Directors may designate part of the Common Elements from time to time for <br />use by less than all of the Unit Owners for specified periods of time. Such <br />designated areas shall be referred to as Limited Common Elements. <br />7 <br />
