Declarant is the owner of certain real property described as: <br />Lots One (1), Two (2), Three (3), Four (4), Five (5), Six (6), Seven (7), <br />and Eight (8) all in Jaxson Subdivision, City of Grand Island, Hall <br />County, Nebraska (the "Property"). <br />B. Declarant desires to and hereby creates a Condominium on the Property <br />pursuant to the Nebraska Condominium Act, Neb. Rev. Stat. § 76-825, et seq., as <br />amended from time to time (the "Act"), in which portions of the Property are <br />designated for separate ownership and the remainder of which are designated for <br />common ownership by Jaxson Condominium Association, Inc., a Nebraska <br />nonprofit corporation (the "Association"). <br />C. Declarant has incorporated the Association for the purpose of exercising the <br />functions herein set forth. <br />ARTICLE 1. SUBMISSION OF PROPERTY <br />Declarant hereby publishes and declares that the Property shall be held, <br />sold, conveyed, transferred, leased, subleased and occupied subject to the <br />following easements, covenants, conditions, and restrictions which are for the <br />purpose of protecting the value and desirability of the Property, and which shall <br />run with the Property and shall be binding upon and inure to the benefit of all <br />parties having any right, title, or interest in the Property, or any portion thereof, <br />their heirs, personal representatives, successors, and assigns. Additionally, <br />Declarant hereby submits the Property to the provisions of the Act. <br />ARTICLE 2. DEFINITIONS <br />1) General.
