GALLES is the Successor Trustee <br />under a Deed of Trust made and entered into on or about August 26, 2019 by STINSON LYLE <br />UNRUH, a single person as Trustor, in which MORTGAGE ELECTRONIC <br />REGISTRATION SYSTEMS, INC., as nominee for CHARTER WEST BANK, its <br />successors and assigns was named as Beneficiary and CHARTER WEST BANK as Trustee, <br />and which was filed for record on August 28, 2019 as Instrument No. 201905226 in the office of <br />the Register of Deeds for Hall County. Said Deed of Trust was assigned by the original <br />Beneficiary, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., as nominee <br />for CHARTER WEST BANK, its successors and assigns to U.S. BANK NATIONAL <br />ASSOCIATION by virtue of an Assignment filed for record May 16, 2022 as Instrument No. <br />202203564 in the office of the Register of Deeds for Hall County, Nebraska. GREGORY L. <br />GALLES was named as Successor Trustee by virtue of a Substitution of Trustee file for record on August <br />24, 2022 as Instrument No. 202206191 in the office of the Register of Deeds of Hall County, Nebraska. <br />GREGORY L. GALLES, Successor Trustee and Grantor, in consideration of the sum of One Hundred <br />Five Thousand Two Hundred One 00/100 Dollars ($105,201.00) and other good and valuable consideration <br />received from JEFFERY SMITH AND PATRICIA SMITH, husband and wife, does hereby grant, <br />bargain, sell, convey and confirm unto JEFFERY SMITH AND PATRICIA SMITH, husband and wife, <br />(hereinafter "Grantee" where appropriate), the following -described real property in Hall County, Nebraska, <br />to wit: <br />Lot Seven (7), in Fractional Block Five (5), in Wallich's Addition to the City of <br />Grand Island, Hall County, Nebraska <br />to have and to hold the above-described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />1. That STINSON UNRUH, a single person as Trustor, failed to pay to Beneficiary payments which <br />were contractually due, and the Grantor, at the request of the Beneficiary, elected to declare the <br />entire unpaid principal balance, together with interest thereon at once immediately due and payable. <br />2. That a Notice of Default as required by §76-1006 was filed by Grantor on August 24, 2022 as <br />Instrument No. 202206209 in the office of the Register of Deeds of Hall County, Nebraska. A <br />copy of said Notice of Default was thereafter mailed to all parties entitled to notice, pursuant to <br />said Deed of Trust and in compliance with §76-1008, R.R.S. Nebraska. <br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days after <br />filing of the Notice of Default. <br />4. That a Notice of Trustee's Sale was prepared by Grantor on September 27, 2022 and mailed to all <br />parties entitled to notice pursuant to said Deed of Trust in compliance with §76-1008, R.R.S. <br />Nebraska. Said Notice of Sale was recorded September 27, 2022, as Instrument No. 202206972 in <br />the office of the Register of Deeds of Hall County, Nebraska. <br />5. That Grantor as required by §76-1007 published a Notice of Trustee's Sale to be held on November <br />30, 2022, at 12:00 p.m. in the lower lobby of the Hall County Courthouse, 111 West First <br />Street, Grand Island, Nebraska.
