In connection with this use, LESSEE agrees to keep the real estate in good <br />appearance and shall maintain it at all times in a clean and attractive cation. <br />LESSEE shall have first option to erect any additional advertising structures on the <br />leased property. <br />5. Ownership: All equipment and materials placed upon the lamed real estate <br />by LESSEE shall remain the property of LESSEE and may be removed by it at any time <br />prior to or within a reasonable time after the expiration of the final term of this Lease. <br />LESSEE shall have the right to make any necessary applications with, and obtain <br />permits from, governmental bodies for the construction and maintenance of LESSEE'S <br />advertising struckre, at the sole ciscretion of LESSEE. All permits shall be and remain <br />the property of LESSEE. LESSOR warrants and represents that he is the owner of the <br />leased real estate and has the right to grant LESSEE free access to the real estate. <br />LESSOR further warrants that he has terminated all current leases on the real estate <br />with regard to outdoor advertising and that LESSEE shall have the sole right to <br />construct and maintain an outdoor advertising structure on the real estate. In the event <br />LESSOR fails to terminate any existing lease for outdoor advertising on the real estate, <br />the LESSOR must immediately refund any rent paid in advance according to paragraph <br />3 to LESSEE and this Lease shall terminate. <br />6. prance and indemnification: LESSEE agrees to obtain and keep in <br />force a policy of public liability insurance for the protection of LESEE and LESSOR <br />against liability arising out of the use of the leased real estate and the improvements <br />placed thereon by LESSEE. LESSEE agrees to indemnity and hold LESSOR harmless <br />from all daims of injury and damages to LESSOR or third parties caused by the <br />installation and maintenance of the outdoor advertising structure or displays on the <br />outdoor advertising structure on the leased real estate. <br />7. Termination: During the term of this Lease, should the use of the leased <br />real estate for the purposes permitted by this Lease be prohibited, limited or restricted <br />by the terms of any restriction, covenant, regulation, mance or zoning resolution <br />affecting the real estate, and in LESSEE'S opinion the location becomes economically <br />or otherwise undesirable, LESSEE may, at its option, terminate this Lease by giving <br />LESSOR thirty (30) days written notice of its election to do so, in accordance with <br />paragraph 3. In addition, either party may terminate this Lease upon breach by the <br />other piety if the breach has not been remedied within thirty (30) days of receipt of such <br />written certified mailing to the breaching party. <br />8. Eminent Domain: If the leased ply, or any part of the leased property, <br />is taken by eminent domain, this Lease shall terminate, at the option of LESSEE, and all <br />Lease payments shall cease at the end of the next full calendar month. <br />2 <br />
