0 <br />N�� <br />0 <br />Cri <br />CO o <br />gkc, <br />2 <br />rn <br />N <br />SECOND AMENDMENT TO AMENDED AND RESTATED DECLARATION OF <br />COVENANTS, CONDITIONS AND RESTRICTIONS <br />OF <br />THE VILLAS AT STOLLEY PARK <br />THIS SECOND AMENDMENT TO AMENDED AND RESTATED DECLARATION OF <br />COVENANTS, CONDITIONS AND RESTRICTIONS (this "Second Amendment") is made and <br />entered into effective September 1, 2022, by The Villas at Stolley Park Owners Association, <br />Inc., a Nebraska nonprofit corporation (the "Declarant") as successor in interest to JEH <br />Holdings, LLC, a Nebraska limited liability company ("JEH") as assigned by that certain <br />Assignment of Amended and Restated Declaration of Covenants, Conditions and Restrictions of <br />The Villas at Stolley Park, dated June 10, 2022 (the "Assignment"). <br />WITNESSETH: <br />WHEREAS, JEH previously made and entered into that certain Amended and Restated <br />Declaration of Covenants, Conditions and Restrictions of the Villas at Stolley Park dated <br />December 20, 2019, as amended by that certain First Amendment to Amended and Restated <br />Declaration of Covenants, Conditions and Restrictions of the Villas at Stolley Park dated April 8, <br />2022 (the "Covenants") which covered the real property located in the County of Hall, Nebraska, <br />and further described on Exhibit A attached hereto (the "Property"), and filed the Covenants of <br />record with the Hall County Register of Deeds on December 31, 2019 as Instrument Number <br />201908192 and May 5, 2022 as Instrument Number 202203308, respectively; <br />WHEREAS, Declarant, in accordance with the authority provided to Declarant pursuant <br />to Section 5.3 of the Covenants, desires to enter into this Second Amendment. <br />herein. <br />NOW, THEREFORE, Declarant hereby desires to amend the Covenants as set forth <br />1. Article 3, Section 3.3 of the Covenants is hereby amended as follows by adding the <br />following section (g): <br />"Rental. The rental of residential dwellings constructed on the Residential Lots is only <br />permitted with a signed lease approved by the Board of Directors. The Board may <br />only decline the lease for specific cause(s) and must advise the owner of such in <br />writing within 72 hours after being provided the lease and background check by the <br />owner. All leases must be for a minimum term of at least 2 years and contain the <br />provisions described below in this Section 3.3(g). All tenants shall be subject to a <br />background check provided by the Owner of the Residential Lot on which the lease <br />is occurring. No more than four (4) of the twenty (20) Residential Lots may contain <br />4874-8257-2859.2 <br />g/CO <br />
