200010301 <br />therefor. Further, each Owner agrees that this paragraph may be pleaded as a bar to the <br />maintenance of such an action. A violation of this provision shall entitle the Association to <br />personally collect, jointly and severally, from the parties violating the same, the actual attorneys' <br />fees, costs, and other damages the Association incurs in connection therewith. <br />8. Use and Occupancy. <br />(A) The Owners of a Unit shall be entitled to the exclusive ownership and possession <br />of their Unit. Each Unit may be used for any lawful use under the applicable zoning ordinance. <br />(B) An Owner may transfer any or all of his /her rights to use the Unit or the Common <br />Elements to his or her tenant. Under no circumstances, however, shall the Owner be relieved of <br />his or her responsibilities as an Owner hereunder. <br />9. Use of Common Elements. <br />(A) Each Owner may use the Common Elements in accordance with the purposes <br />for which they are intended, so long as such use does not hinder or encroach upon the lawful <br />rights of other Owners nor violate the Condominium Documents. <br />(B) In addition to the rights of use herein described and elsewhere described in this <br />Declaration, the Association, and its Board, Managing Agent, employees and independent <br />contractors shall have an unrestricted, irrevocable easement to traverse, cross, and utilize any <br />portion of the Common Elements or the Units which may be necessary in order to install, <br />maintain, repair, or replace any Common Elements. <br />(C) The water and sewer bill is not separately metered between the two <br />condominium units and is billed to 1736 Doreen St. The automatic sprinkler controls are under <br />the control of the owner of 1736 Doreen St. The Owner of 1736 Doreen St. shall accept the <br />input of the owner of 1734 Doreen St. to determine sprinkler schedules and watering amounts. <br />The bill for water and sewer shall be split according to Paragraph 10 below as a common <br />expense. <br />10. Allocated Interests. <br />(A) The Allocated Interests for the Condominium Units are shown on the Schedule of <br />Allocated Interests in Exhibit "A ". The Allocated Interest means the undivided interest in the <br />Common Elements and the expense, liabilities, Association assessments and special <br />assessments, and members votes in the Association on specific matters affecting the Common <br />Elements, and the individual interest in the Common Elements, Common Expense Liabilities, <br />Association assessments and special assessments on the Common Elements and member's <br />votes in the Association on general Association matters and specifically those matters affecting <br />Common Elements. <br />-5- <br />
