200010301 <br />6. Description of Condominium Unit. <br />(A) Every contract for the sale of a Condominium Unit shall legally describe a <br />Condominium Unit by its identifying Unit designation, followed by the words "South Doreen <br />Condominiums." The location of such Condominium Unit shall be depicted on the Plats and <br />Plans. <br />(B) After the Declaration, along with the attached Plats and Plans, has been <br />recorded in the records of the Register of Deeds of the County, every deed, lease, Mortgage, <br />will, or other instrument shall legally describe a Condominium Unit as follows: <br />1734 Doreen St. or 1736 Doreen St., South Doreen <br />Condominiums, a Condominium in accordance with the <br />Declaration recorded on tl-)— 2000, under Instrument No. (2) of <br />the County of Hall, State of Nebraska, records. <br />Where (1) is the month and day this Declaration is recorded and _(2) is the instrument <br />number given this Declaration upon recordation. <br />Every such description shall be good and sufficient for all purposes to sell, convey, <br />transfer, encumber, or otherwise affect not only the Unit, but also the undivided interest in the <br />Common Elements appurtenant to said Unit and all other appurtenant properties and property <br />rights, and shall incorporate all the rights and burdens incident to ownership of a Condominium <br />Unit and all of the limitations thereon as described in this Declaration including the attached <br />Plats and Plans and other exhibits hereto and in the Bylaws. Each such description shall be <br />construed to include a nonexclusive easement for ingress and egress to and from an Owner's <br />Unit to the nearest public street, and the use of all of the Common Elements. <br />(C) The reference to the Declaration in any instrument shall be deemed to include <br />and incorporate any attached addenda, schedules, exhibits, Plats and Plans, or any <br />supplements and amendments to the Declaration, including attachments hereto, without specific <br />references thereto. <br />7. Non - Partitionability of Common Elements. <br />The Common Elements shall be owned by all of the Owners and based on their <br />Allocated Interests described in Paragraph 12 and shall remain undivided. By the acceptance <br />of a deed or other instrument of conveyance or assignment, each Owner specifically waives his <br />right to institute and maintain a partition action or any other action designed to cause a division <br />of the Common Elements, and each Owner specifically agrees not to institute any action <br />ME <br />
