20001030. (D) Amendments. Amendments to the Declaration required by the Nebraska Uniform Condominium Act to be recorded by the Association shall be prepared, executed, recorded, and certified on behalf of the Association by any officer of the Association designated for that purpose or, in the absence of designation, by the President of the Association. (E) Proviso. Except to the extent permitted by the terms and conditions contained herein, no amendment shall unlawfully discriminate against any Unit Owner or against any Unit, and no amendment may create or increase the number of Units, change the boundaries of any Unit, the Allocated Interests of a Unit, or the uses to which any Unit is restricted, in the absence of the unanimous consent of the Unit Owners. 24. Termination. (A) Except in the case of a complete taking of all the Units of the Condominium Protect by eminent domain, the Condominium may be terminated only by unanimous agreement of the Owners of Units to which votes of the Association are allocated. (B) An agreement to terminate must be evidenced by the execution of a termination agreement, or ratification thereof, in the same manner as a deed, by Owners of all Units to which votes of the Association are allocated. Said termination agreement must specify a date after which the agreement will be void unless it is recorded before that date. The termination agreement and all ratification thereof is effective only upon recordation in the County. The Uniform Condominium Act shall govern any termination. 25. General. (A) If any of the provisions of the Condominium Documents or any paragraph, sentence, clause, phrase, or word, or the application thereof in any circumstances shall be invalidated, such invalidity shall not affect the validity of the remainder of the Condominium Documents, and the application of any such provision, paragraph, sentence, clause, phrase, or word in any other circumstance shall not be affected thereby. (B) The provisions of the Condominium Documents shall be in addition and supplemental to the Nebraska Uniform Condominium Act and to all other provisions of law, and the provisions of such Act shall apply in the event of conflict with, or omission from, Condominium Documents of provisions required by the Nebraska Uniform Condominium Act.
