20001030. <br />(D) Amendments. Amendments to the Declaration required by the Nebraska <br />Uniform Condominium Act to be recorded by the Association shall be prepared, executed, <br />recorded, and certified on behalf of the Association by any officer of the Association designated <br />for that purpose or, in the absence of designation, by the President of the Association. <br />(E) Proviso. Except to the extent permitted by the terms and conditions contained <br />herein, no amendment shall unlawfully discriminate against any Unit Owner or against any Unit, <br />and no amendment may create or increase the number of Units, change the boundaries of any <br />Unit, the Allocated Interests of a Unit, or the uses to which any Unit is restricted, in the absence <br />of the unanimous consent of the Unit Owners. <br />24. Termination. <br />(A) Except in the case of a complete taking of all the Units of the Condominium <br />Protect by eminent domain, the Condominium may be terminated only by unanimous agreement <br />of the Owners of Units to which votes of the Association are allocated. <br />(B) An agreement to terminate must be evidenced by the execution of a termination <br />agreement, or ratification thereof, in the same manner as a deed, by Owners of all Units to <br />which votes of the Association are allocated. Said termination agreement must specify a date <br />after which the agreement will be void unless it is recorded before that date. The termination <br />agreement and all ratification thereof is effective only upon recordation in the County. The <br />Uniform Condominium Act shall govern any termination. <br />25. General. <br />(A) If any of the provisions of the Condominium Documents or any paragraph, <br />sentence, clause, phrase, or word, or the application thereof in any circumstances shall be <br />invalidated, such invalidity shall not affect the validity of the remainder of the Condominium <br />Documents, and the application of any such provision, paragraph, sentence, clause, phrase, or <br />word in any other circumstance shall not be affected thereby. <br />(B) The provisions of the Condominium Documents shall be in addition and <br />supplemental to the Nebraska Uniform Condominium Act and to all other provisions of law, and <br />the provisions of such Act shall apply in the event of conflict with, or omission from, <br />Condominium Documents of provisions required by the Nebraska Uniform Condominium Act. <br />IN WI NESS WHEREOF, Declarants have executed this Declaration this P7 day of <br />, 2000. <br />-14- <br />
