Owner's Obligation for Payment of Assessments. <br />All amounts assessed by the Association against each Condominium Unit, whether as a <br />Common Expense, special, or penalty assessment, shall be the personal and individual debt of <br />each Owner thereof at the time the assessment is made. Suit to recover a money judgment for <br />unpaid assessments shall be maintainable without foreclosing or waiving the lien securing, the <br />same. No Owner may exempt himself /herself from liability for the Owner's contribution toward <br />the Common Expenses by a waiver of the use or enjoyment of any of the Common Elements or <br />by abandonment of his /her Condominium Unit. <br />20. Resale of Unit: Liability for Common Expenses Upon Transfer of Condominium Unit. <br />(A) Unless exempt by the Nebraska Uniform Condominium Act, a Unit Owner and <br />any other person in the business of selling real estate who offers for resale a Unit to a purchaser <br />after the initial sale of the Unit from the Declarant shall furnish to a purchaser before <br />conveyance a copy of this Declaration other than the Plats and Plans, the Bylaws, the Rules or <br />Regulations of the Association, and any other information required by purchaser. <br />The Association, within ten (10) days after a request by Unit Owner, shall furnish in <br />writing the information necessary to enable the Unit Owner to comply with the Nebraska <br />Uniform Condominium Act (§ 76 -884). <br />(B) Upon payment of a reasonable fee and upon the written request of any Owner, <br />any purchaser or prospective purchaser, any Mortgagee, or any prospective Mortgagee, the <br />Association shall issue the Information Certificate described in Subparagraph (A) hereof, with <br />respect to such Condominium Unit, and if requested, the amount of the current monthly <br />assessment and the date that such assessment becomes due, and any credits for advanced <br />payments or for prepaid items, including, but not limited to, insurance premiums, which <br />statement shall be conclusive upon the Association in favor of all persons who rely thereon in <br />good faith. Unless such request for the Information Certificate shall be complied with within ten <br />(10) days, all unpaid Common Expenses which become due prior to the date of making such <br />request shall be subordinate to the interest of the Owner, purchaser or prospective purchaser <br />requesting such Information Certificate, or to the lien of the Mortgagee or prospective <br />Mortgagee requesting such Information Certificate. <br />(C) The grantee of a Unit, including a Mortgagee with a superior lien as set out in <br />Paragraph 18 (Lien for Nonpayment of Assessments) herein who comes into possession of a <br />Condominium Unit pursuant to the remedies provided in its Mortgage or becomes an Owner of <br />a Condominium Unit pursuant to foreclosure of its Mortgage or by the taking of a deed in lieu <br />thereof, and any purchaser at a foreclosure sale, shall not be liable with the grantor for unpaid <br />5FAI <br />
