200010301 <br />or decisions and resolutions of the Association, by permanent injunction <br />or otherwise; or <br />(ii) by commencing and maintaining actions to recover damages for breach <br />of any of the provisions of the Condominium Documents, or decisions and <br />resolutions of the Association. <br />(B) All attorneys' fees and other costs of enforcing the Condominium Documents, or <br />decisions and resolutions of the Association, incurred by the Association, or, in a proper case by <br />an aggrieved Owner, shall be assessed against the Owner found to be in violation, and such <br />assessment shall become a lien against such Owner's Condominium Unit and shall be enforced <br />and collected in the same manner as all other assessments provided for herein. <br />(C) The conveyance or encumbrance of a Condominium Unit shall be deemed to be <br />made subject to all of the provisions of the Condominium Documents, and shall be binding upon <br />each grantee or Mortgagee without the necessity or inclusion of such express provision in the <br />instrument of conveyance or encumbrance. <br />17. Assessment for Common Expenses. <br />(A) All Owners, shall be obligated to pay the estimated and actual assessments <br />imposed by the Association to meet the Common Expenses and reserves. The Common <br />Expenses shall be allocated to all Units based upon the Allocated Interest as shown in Exhibit <br />"A" of the Declaration. The Owners shall share the cost of maintaining the Common Elements <br />which comprise the driveways, sidewalks, lawn and trees in accordance with the Allocated <br />Interests. <br />(B) Annual assessments for the estimated Common Expenses shall be payable in <br />annual or other periodic instalments as determined by the Board and shall be due in advance on <br />the first day of each calendar month or at other times as the owners may agree. <br />(C) Each Owner shall be obligated to pay all charges for any separately metered <br />utilities, including but not limited to electricity, gas, and cable television, servicing his /her <br />Condominium Unit. In the event that any utilities are master metered, then such utility service <br />shall be part of the Common Expense assessments as hereinbefore provided and shall be <br />allocated to Units benefiting from such service, depending upon the manner in which they are <br />separately metered. Allocations shall be based on appropriate respective Allocated Interests, <br />except as otherwise provided. <br />-10- <br />
