20220125q <br />(a) If any chute, flue, duct, wire, conduit, bearing wall, bearing <br />column or any other fixture lies partially within and partially outside the <br />boundaries of a unit, any portion serving only that unit is a limited common <br />element allocated to that unit, and any portion serving more than one unit <br />or any portion of the common elements is a part of the common elements. <br />(b) Any shutters, awnings, window boxes, doorsteps, stoops, <br />porches, balconies, patios and all exterior doors and windows or other <br />fixtures designed to serve a single unit, but located outside the unit's <br />boundaries, are limited common elements allocated to that unit. <br />(c) The telecommunications headend site, consisting of a stand- <br />alone building and fenced -in area surrounding the same, located to the south <br />and west of Unit Seven (7), shall be a limited common element allocated to <br />Unit Seven (7). <br />2. Section 11 of the Declaration is hereby amended to read as follows: <br />11. Maintenance and Improvement of the Units. Each unit shall be maintained by <br />the unit owner. Each unit owner shall promptly report to the Executive Board of Directors <br />of the association any need for repairs for which the association is responsible. <br />Notwithstanding the general provisions for maintenance, the Executive Board of Directors <br />may establish specific maintenance responsibilities that shall be uniform as to all units. <br />Absent establishment of other specific maintenance responsibilities by the <br />Executive Board of Directors, each owner of any unit, at the unit owner's own expense, <br />shall maintain, repair, replace and restore all doors, window glass, and any heating, cooling <br />and air conditioning systems and equipment exclusively serving said unit, and all electrical <br />and plumbing fixtures and appliances exclusively serving said unit, including without <br />limitation laundry equipment, water heaters, and other built-in appliances. Each owner <br />shall clean, maintain, repair, replace and restore all interior finishes, including without <br />limitation floor coverings and wall coverings. No owner shall remove, alter, injure or <br />interfere in any way with any shrubs, trees, grass or plantings placed upon the <br />condominium by the Declarant or the association without first having obtained the written <br />consent of the association. In addition, each owner shall be responsible for the maintenance <br />and repair of the limited common elements (except for the structural parts of the limited <br />common elements) to which said owner has the right of exclusive use pursuant to Section <br />5(a), 5(b), or 5(c) of this Declaration. Each owner shall take all necessary action to keep <br />the limited common elements free and clear from unsightly accumulations of weeds, trash <br />and litter. <br />A unit owner may make any improvements or alterations to the unit that do not <br />impair the structural integrity or mechanical systems or lessen the support of any portion <br />2 <br />
