Walsh <br />104 N Wheeler Avenue <br />Grand Island NE 68801 <br />da 00 <br />AMENDMENT TO THE DECLARATION OF PARK ISLAND SQUARE II BUSINESS <br />CONDOMIUMS <br />THIS AMENDMENT is made this ('1 day of February, 2022, by the undersigned, being <br />the Declarant and current owner of all units contained in the condominium identified as PARK <br />ISLAND SQUARE II BUSINESS CONDOMINIUMS (hereinafter referred to as "Owner"), for <br />itself and for its successors, grantees, and assigns. <br />WITNESSETH: <br />WHEREAS, a DECLARATION OF PARK ISLAND SQUARE II BUSINESS <br />CONDOMINIUMS (hereinafter referred to as "the Declaration") was filed in the Office of the <br />Register of Deeds of Hall County, Nebraska, on December 23, 2021, as Instrument No. <br />202110859, which Declaration was recorded against the following described real estate, to -wit: <br />Lot Two (2), Park Island Square Fifth Subdivision, and Lots One (1) and Two (2), <br />Park Island Square Sixth Subdivision, all in the City of Grand Island, Hall County, <br />Nebraska; and <br />WHEREAS, as of the date first written above, Mid -Country Trading, L.L.C., a Nebraska <br />limited liability company, Declarant, retains developmental rights and control pursuant to Section <br />6 of the Declaration; and <br />WHEREAS, there are currently Twelve (12) units in PARK ISLAND SQUARE II <br />BUSINESS CONDOMINIUMS, all of which are owned by Mid -Country Trading, L.L.C.; and <br />WHEREAS, Section 38 of the Declaration provides that the condominium established by <br />the Declaration may be amended, in writing, by the Declarant at any time during the period that <br />Declarant shall retain developmental rights and control, or by the unit owners of Sixty -Seven <br />Percent (67%) of the units at any time; and <br />WHEREAS, Mid -Country Trading, L.L.C., as the Declarant exercising developmental <br />rights and control and as the owner of all units in PARK ISLAND SQUARE II BUSINESS <br />CONDOMINIUMS, desires to amend the Declaration. <br />KNOW ALL MEN BY THESE PRESENTS: <br />1. Section 5 of the Declaration is hereby amended to read as follows: <br />5. Common Elements. The common elements are all portions of the condominium <br />other than the units. All spaces, interior partitions and other fixtures and improvements <br />within the boundaries of a unit are part of the unit.
