200109649 <br />This land is referred to in this agreement as the premises: the right -of -way is referred to as <br />the right -of -way. <br />SECTION II <br />TERM <br />The rights granted in this Agreement shall be possessed and enjoyed by the Grantee as long <br />as the pipeline, well and well house and the appurtenances associated therewith shall be maintained <br />and operated by Grantee. <br />SECTION III <br />RIGHTS OF GRANTEE <br />Grantee shall have the right of ingress and egress to and from the premises for any and all <br />purposes necessary or convenient to the exercise of the Grantee of the rights granted in this <br />Agreement to include but not be limited to construction, installation and maintenance of said water <br />system; removal of all timber, brush or other natural growth which may interfere, prohibit or <br />damage the improvements to be made thereon; the installation of fencing, gate work or other <br />barriers for purposes of protecting or restricting said easement. <br />SECTION IV <br />WARRANTY OF TITLE <br />Grantor covenants that Grantor is the owner of the premises and has the right, title and <br />capacity to grant the right -of -way granted in this agreement. <br />SECTION V <br />EFFECTIVE AGREEMENT <br />This Agreement shall be binding on the heirs, legal representatives, successors and assigns <br />of the parties. <br />NEBRASKA TRAP ASSOCIATION, <br />Grantor <br />By <br />Mike Morgan, P ident <br />
