20211'035 <br />proceed to determine the matter questions, disagreement, or difference, and the decision of any two <br />of them shall be final, conclusive and binding upon all parties. In all cases of arbitration, the parties <br />hereto shall each pay the expense of its own attorneys and witness fees, and all other expenses of such <br />arbitration shall be divided equally between the parties. <br />ARTICLE VII. <br />GENERAL RESTRICTIONS AND RESPONSIBILITIES <br />Section 1. Awnings. No awnings or sunscreens of any type shall be affixed to any <br />building or structure within the properties without the written consent of the Architectural Committee. <br />Section 2. Buildings or Uses Other than for Residential Purposes. No commercial or <br />business activity of any kind shall be operated on, or from any Lot in Fairway Meadows, which shall <br />bring or cause clients, customers or coworkers to come on to the Property for business purposes. No <br />building or structure of any sort may ever be placed, erected, or used for business, professional trade, <br />or commercial purposes on any of the property within the properties. Provided, however, the <br />prohibition shall not apply: <br />(A) To any building or structure that is to be used exclusively by a public utility <br />company in connection with the furnishing of public utility services to the <br />properties, if written permission for such placement, erection or use under (a) <br />above is first obtained from the Committee. <br />(B) Garage sales may be held with the permission of the Board of Directors or the <br />Social Committee. Any Owner wishing to conduct a garage sale must submit a <br />written request to the Social Committee as least two (2) weeks prior to the <br />proposed date of said garage sale. <br />Section 3. Fences, etc. No fences or enclosures of any type or nature whatsoever shall <br />ever be constructed, erected, placed, or maintained on or about any building site within the properties, <br />except such fences or enclosures as may be authorized by the Architectural Committee. No truck, <br />trailer, boat, motor home, camper, equipment, or machinery or cars not in daily use shall ever be <br />parked, located, or otherwise maintained on any properties. Automobiles shall be parked only in <br />designated parking areas as published by the Committee in its Rules and Regulations. Receivers for <br />satellite television must not be mounted on the side of any building, and shall not be permitted on any <br />roof. No clothes lines or clothes hangers may be constructed or used unless completely concealed <br />within enclosed patio areas. <br />Section 4. Livestock and Poultry Prohibited. No animals, livestock, or poultry of any <br />kind shall be raised or kept on any property in the Fairway Meadows Homeowners Association. <br />House pets are to be confined to the Owner's immediate property. Pets should be leashed, chained, <br />or tended to at all times. Droppings or other animal waste shall be picked up by the Owner and <br />properly disposed of. No fenced or walled areas for pets shall be allowed outside of the private patio <br />or areas approved by the Association. <br />Section 5. Each homeowner is responsible for replacing any dead or damaged shrubs or <br />trees on their property. Any and all tree replacements shall be approved by the Architectural <br />committee in accordance with the approval processes specified in the Covenants. The homeowner is <br />responsible for the elimination of weeds and debris, including in rock areas. If any Owner fails to <br />replace dead of damaged shrubs or trees, or eliminate weeds and debris, the Association shall provide <br />written notice of said failure to the Owner. If after fourteen (14) days of receiving notice the Owner <br />has failed to correct such failure, the Association may perform such work and invoice the Owner <br />thereof and secure and enforce a claim and lien. <br />Section 6. Each Townhome shall be used and occupied only by one family and guests as <br />a residence and for no other purpose. No Townhome can be subdivided into smaller units. No <br />Townhome shall be leased or otherwise rented to a tenant or lessee. <br />6 <br />
