202111035 <br />Section 2. "Owner" shall mean and refer to the record owner, whether one or more persons <br />or entities, of a fee simple title to any lot which is part of the above described legal description, <br />specifically Lots eighteen (18) through thirty-seven (37) inclusive of Coach Place Subdivision to <br />the City of Grand Island, Hall County, Nebraska. <br />Section 3. "Property" shall mean and refer to the certain real estate first describe herein, <br />and such additions thereto as may be hereafter be annexed to the properties as provided herein. <br />Section 4. "Common Area" shall mean all real property on the Property, exclusive of the <br />platted Lots eighteen (18) through thirty-one (31) as shown on the plat of Coach Place Subdivision, <br />as well as Lots thirty-two (32) through thirty-seven (37) in the name of Fairway Meadows <br />Homeowners Association, Inc., in October 1996. <br />Section 5. "Lot" shall mean and refer to any plated lot of land shown upon the recorded <br />subdivision map of the properties with the exception of the common area. <br />Section 6. "Townhome" shall mean and refer to any single residential unit constructed on <br />the Property. <br />ARTICLE II. <br />PROPERTY RIGHTS <br />Section 1. Owner's Easements of Enjoyment. Every Owner shall have, and there is hereby <br />granted to all Owners a right and easement of enjoyment in and to the Common Area located as above <br />described within the properties which easement shall be appurtenant to and shall pass with the title to <br />every lot, subject to the right of the Association to suspend the voting rights and right to use the <br />recreational facilities by an Owner for any period during which any assessment against his or her Lot <br />remains unpaid. <br />Section 2. Delegation of Use. Any Owner may delegate his or her right of enjoyment to the <br />common area and facilities to the members of his or her family or guests, provided, however, that said <br />Owner shall be responsible to the Association for the conduct upon and use by said family or guest <br />of the common area. <br />ARTICLE III. <br />MEMBERSHIP AND VOTING RIGHTS <br />Section 1. Every Owner of a lot within the properties shall be a member of the <br />Association. Membership shall be appurtenant to and may not be separated from Ownership of any <br />lot which is subject to assessment. <br />Section 2. The Association shall have one class of voting memberships. <br />(A) "Resident Member" shall be all Owners and Owners shall be entitled to one <br />vote for each Townhome Owner. When more than one person holds an <br />interest in any property, all such persons shall be members. The vote for such <br />Townhome shall be exercised as they among themselves determine, but in no <br />event shall more than one vote be cast with respect to any Townhome. <br />Section 3. The Association will annually elect Officers: President, Vice President, <br />Treasurer, and Secretary. These officers will constitute the Board of Directors. The President will <br />appoint Committee Chairmen as follows; Grounds Committee, Architectural, and Social Committee. <br />All officers will serve a minimum of one year and may, with a vote of Association, serve more than <br />one term. Meetings will be governed by Robert's Rules of Order. <br />(A) "Meetings". The annual meeting will be held during the first two weeks of <br />2 <br />
