SECOND AMENDED AND <br />RESTATED AGREEMENT FOR PROTECTIVE COVENANTS, AND RESTRICTIONS AND <br />CONDITIONS FOR LOTS EIGHTEEN (18) TO THIRTY-SEVEN (37) COACH PLACE <br />SUBDIVISION <br />WHEREAS, FAIRWAY MEADOWS ESTATES OWNERS ASSOCIATION <br />AGREEMENT OF COACH PLACE SUBDIVISION was recorded at the Hall County Register of <br />Deeds as Document Number 93-106187 on July 22, 1993 ("1993 Covenants"); and <br />WHEREAS, the AMENDED AGREEMENT FOR THE FAIRWAY MEADOWS <br />HOMEOWNERS ASSOCIATION, INC. RESTRICTIVE COVENANTS AND CONDITIONS <br />GRAND ISLAND, NEBRASKA was recorded at the Hall County Register of Deeds as document <br />number 97-110952 on December 30, 1997 ("1997 Covenants"); and <br />WHEREAS, the 1993 Covenants may be amended by a majority vote of the homeowners and <br />the 1997 Covenants may be amended by an instrument signed by the owners of not less that eighty <br />percent (80%) of the lots; and <br />WHEREAS, at least eight percent (80%) of the Owners, as herein defined, of the lots have <br />executed these FAIRWAY MEADOWS HOMEOWNERS ASSOCIATION, INC. SECOND <br />AMENDED AND RESTATED AGREEMENT FOR PROTECTIVE COVENANTS, AND <br />RESTRICTIONS AND CONDITIONS FOR LOTS EIGHTEEN (18) TO THIRTY-SEVEN (37) <br />COACH PLACE SUBDIVISION (the "Covenants") for the purpose of rescinding all prior <br />covenants which are replaced by these Covenants upon the Property, as herein defined. <br />NOW, THEREFORE, the undersigned Owners hereby adopt the Covenants in replacement <br />and substitution of the prior covenants for the Property and declare that the Property, Lots, as <br />herein defined, Common area, as herein defined, and Townhomes, as herein defined, shall be held, <br />sold and conveyed subject to the Covenants which are for the purpose of protective the value and <br />desirability of each of the foregoing, and which shall run with the land and be binding on all parties <br />having any right, title or interest in any of the Property, their heirs, successors and assigns. <br />ARTICLE I. <br />DEFINITIONS <br />Section 1. "Association" shall mean and refer to Fairway Meadows Homeowners <br />Association, Inc., a Nebraska non-profit corporation, its successors and assigns. <br />
