202110859 <br />26. Use of Common Elements. The association and each unit owner shall have the right <br />to use the common elements, other than limited common elements, and shall have an easement <br />over the common elements for that use. <br />The association, and each unit owner of a unit to which a limited common element is <br />assigned, shall have the right to use such limited common element and shall have an easement over <br />such limited common element for that use. <br />27. Easements over Common Elements. The Executive Board of Directors of the <br />association may grant easements, leases, licenses and concessions over the common elements for <br />the installation and maintenance of utilities and for such other purposes as the Board deems to be <br />in the best interests of the condominium. <br />28. Rules and Regulations. By a majority vote of its Executive Board of Directors, the <br />association may, from time to time and subject to the provisions of this Declaration, adopt, amend <br />and repeal rules and regulations applicable to this condominium. Those rules and regulations may, <br />among other things, restrict and govern the use of any area by any owner, by the family of such <br />owner, or by an invitee, licensee or lessee of such owner; provided however, that such rules and <br />regulations may not unreasonably discriminate among owners and shall not be inconsistent with <br />this Declaration or the association's By -Laws. A copy of the rules and regulations as they may <br />from time to time be adopted, amended or appealed, shall be mailed or otherwise delivered to each <br />unit owner and may be recorded in the office of the Hall County Register of Deeds. <br />29. Common Expenses and Lien. The members shall pay annual and special assessments <br />for the common expenses. Annual and special assessments shall be in proportion to allocated <br />interests as hereinabove set forth in Section 7, except as follows: <br />(a) Any common expense associated with the maintenance, repair or <br />replacement of a limited common element must be assessed against the units to <br />which that limited common element is assigned; <br />(b) Any common expense, or portion thereof, benefiting fewer than all of <br />the units must be assessed exclusively against the units benefited; and <br />(c) Any common expense caused by the misconduct of any unit owner or <br />such unit owner's invitee may be assessed by the association exclusively against <br />that owner's unit. <br />Each assessment shall be the personal obligation of the member who is the unit owner of the unit <br />assessed at the time of the assessment and shall bear interest at the rate of Sixteen Percent (16%) <br />per annum from the date established by the Executive Board of Directors of the association until <br />paid. <br />Page 9 of 12 <br />
