202110773 <br />TERMINATION OF AGREEMENT FOR RESTRICTIVE COVENANTS, EASEMENT AND <br />RIGHT OF FRIST REFUSAL <br />This Termination of Agreement for Restrictive Covenants, Easement and Right of First <br />Refusal is made and executed this 74 day of /f��<.�_ , 2021 by and between GREGORY <br />T. BAXTER, PERSONAL REPRESENTATIVE OF THE ESTATE OF THOMAS BAXTER, <br />DECEASED ("the Personal Representative"), GIAN BAXTER COLLINS ("Gian") and <br />MICHAEL COLLINS ("Michael"). <br />WITNESSETH: <br />WHEREAS, Gian entered into an Agreement for Restrictive Covenants, Easement and <br />Right of First Refusal with ELIZABETH BAXTER ("Elizabeth") and TOM BAXTER ("Tom") <br />recorded October 30, 2014 as Document No. 201406877 with the Hall County Register of Deeds <br />("the 2014 Agreement"); and <br />WHEREAS, Gian was known as GIAN BAXTER ROBERTS at the time she entered into <br />the 2014 Agreement; and <br />estate: <br />WHEREAS, Elizabeth had sold and Gian had purchased the following described real <br />Lot Two (2), Baxter Acres Subdivision, in the City of Grand Island, Hall County, <br />Nebraska ("the Purchased Property); and <br />WHEREAS, Elizabeth had retained ownership of the following described real estate: <br />Lot One (1), Baxter Acres Subdivision, in the City of Grand Island, Hall County, <br />Nebraska ("the Retained Property"); and <br />WHEREAS, Tom joined in the execution of the 2014 Agreement as to his marital interest <br />as Elizabeth's husband; <br />WHEREAS, Elizabeth died April 30, 2020; and <br />WHEREAS, the Retained Property was conveyed to Tom by a Deed of Distribution by <br />Personal Corepresentatives recorded January 7, 2021 as Document No. 202100151 with the Hall <br />County Register of Deeds; and <br />WHEREAS, Tom died January 12, 2021; and <br />WHEREAS, the Personal Representative was appointed in a proceeding entitled "In the <br />Matter of the Estate of Thomas Baxter, Deceased" at Case No. PR21-13 in the County Court of <br />Hall County, Nebraska; and <br />WHEREAS, Gian and Michael are wife and husband; and <br />2 <br />
