Any application <br />of proceeds to the Obligations shall not extend or postpone the due date of any <br />payments under any promissory note, or cure any default under such note or this <br />Deed of Trust. <br />4. Environmental Compliance. Trustor hereby warrants and represents that there <br />are no environmental conditions at or about the Premises that constitute a <br />violation of any existing laws or regulations. <br />Trustor hereby warrants and represents that there are no pending or threatened <br />lawsuits, administrative actions, or governmental inspections or investigations <br />which involve environmental claims or conditions at or about the Premises. <br />Trustor shall comply with all Federal, State and local environmental laws, <br />ordinances, rules, requirements, regulations and publications as now existing or <br />hereafter existing relating to environmental conditions or the regulation and <br />control of toxic or hazardous substances or materials. <br />Trustor hereby indemnifies and holds Beneficiary, its successors and assigns, <br />harmless from and against any and all claims, damages, losses and liabilities <br />arising in connection with the presence, use, disposal or transport of any <br />substance which is the subject of any environmental law or regulation dealing <br />with toxic or hazardous substances or materials on, under, from or about the <br />Premises. This indemnity shall survive reconveyance of the Premises secured <br />by this Deed of Trust. <br />5. Use and Preservation of Premises. Trustor shall use the Premises for lawful <br />business or agricultural purposes only; shall not substantially change the <br />Premises, allow the Premises to deteriorate, or commit or permit waste. Trustor <br />shall comply with all laws and regulations applicable to the use of the Premises, <br />and shall maintain the improvements thereon in good repair. <br />6. Protection of Trust Premises. If Trustor fails to pay taxes or assessments, <br />maintain insurance or maintain the Premises as provided herein, Beneficiary, in <br />its sole discretion, may pay any such amounts or take steps to protect the value <br />of the Premises and the rights of Beneficiary in the Premises. Any sums <br />Beneficiary advances for payments of any such taxes or assessments, <br />maintenance or protection of the Premises shall be secured by this Deed of <br />Trust, shall constitute a debt due from Trustor to Beneficiary, and shall bear <br />interest thereon at the default rate provided in the Note. <br />7. Inspection. Beneficiary, its employees and agents, may make reasonable <br />entries on the Premises for purposes of inspection. <br />8. Forbearance Not Waiver. Failure by Beneficiary to exercise any right or remedy <br />available under this Deed of Trust or the Note on any one default shall not waive <br />or preclude the exercise of any right or remedy in the event of any subsequent <br />default. <br />9. Eminent Domain. Trustor shall give to Beneficiary prompt notice of any action, <br />actual or threatened, in condemnation or eminent domain of all or any part of the <br />Premises and hereby assigns, transfers and sets over to Beneficiary the entire <br />proceeds of any compensation, award, or other payments or relief granted for <br />the taking of the Premises by the exercise of such eminent domain, <br />condemnation proceeding, or in any other manner. <br />Beneficiary, in its sole discretion, shall apply the proceeds received to payment <br />of (i) any expenses incurred by Beneficiary collecting such proceeds, (ii) to the <br />Obligations, whether due or not, or (iii) to the restoration or repair of the <br />Premises. <br />
