202105789 (ii) Sidewalks shall be maintained in a level and smooth condition and shall be pressure washed periodically. (iii) All papers, debris, snow, ice, litter and refuse shall be removed, and the parking areas and sidewalks shall be swept per IHOP's corporate standards and maintained in a neat, clean and orderly condition. Snow will be plowed in a commercially reasonable manner but not necessarily removed from the parking lot. Trash disposal areas shall be screened from public view. (iv) All appropriate directional signs, monument signs, markers and striping shall be maintained in good repair (and replaced as necessary), and lamps in lighting standards shall be replaced as necessary. (v) All landscaped areas of the Owner Property shall be maintained in a neat and attractive condition (including replacing existing landscaping, as necessary). (vi) Parking areas shall be free of trailers (other than trailers in the loading areas of the improvements used for deliveries) and derelict and unauthorized vehicles. (vii) Traffic control shall be provided to insure the orderly flow of traffic. (viii) Any unimproved portion of the Owner Property shall be graded and seeded, free of'weeds, and the grass shall be maintained weekly during the growing season. 8. INSURANCE. (a) Commencing on the date of this Agreement and at all times thereafter, Owner shall maintain or cause to be maintained in full force and effect on the Owner Property at least the minimum insurance coverages set forth below: (i) Commercial General Liability Insurance with a limit of liability of not less than One Million Dollars ($1,000,000.00) per occurrence and Two Million Dollars ($2,000,000.00) aggregate for bodily injury, personal injury and property damage. Developer and Staenberg Group, Inc., a Missouri corporation, d/b/a TSG Properties shall be "additional insureds" under such policy. The insurance provided herein shall be considered "primary" and "non-contributory" insurance, and all limits of such policy shall be exhausted before insurance of another party is considered. (ii) Workers' Compensation Insurance as required by any applicable law or regulation and Employer's Liability Insurance in the amount of One Million Dollars ($1,000,000.00) each accident for bodily injury, One Million Dollars ($1,000,000.00) policy limit for bodily injury by disease, and One Million Dollars ($1,000,000.00) each employee for bodily injury by disease. (iii) Automobile Liability Insurance for owned, hired and non -owned automobiles with limits of liability not less than One Million Dollars ($1,000,000.00) combined single limit each accident for bodily injury and property damage. (iv) Umbrella Liability Insurance in the amount of Three Million Dollars ($3,000,000.00) providing coverage over and above the amounts of the commercial general 7
