"Association" shall mean the homeowners' association to be formed by the <br />Owners to be known as "Greenstreet Townhomes Association" and its <br />successors and assigns. <br />b. "Owner" shall mean an owner of Lots Seventeen (17) through Twenty (20), <br />Thelen Subdivision, First Addition, Wood River, Hall County, Nebraska. <br />c. "Properties" shall mean and refer to Lots Seventeen (17) through Twenty <br />(20), Thelen Subdivision, First Addition, Wood River, Hall County, <br />Nebraska. <br />d. "Lot" shall mean and refer to any platted lot of land upon the recorded <br />subdivision plat of the Properties and shall include only Lots Seventeen (17) <br />through Twenty (20), Thelen Subdivision, First Addition, Wood River, Hall <br />County, Nebraska, such plat being recorded in the Office of the Register of <br />Deeds of Hall County, Nebraska. <br />2. Every Owner of a Lot within the Properties shall be a member of the Association. <br />Membership in the Association is a condition of ownership of any Lot within the Properties. <br />Membership shall be appurtenant to and may not be separated from ownership of any Lot which <br />is subject to assessment. The Association shall have one class of voting membership which shall <br />be and include the Owner of each Lot contained in the Properties. When more than one (1) person <br />holds an interest in any Lot contained within the Properties, all such persons shall be members of <br />the Association but any vote for such Lot shall be exercised as they among themselves determine <br />with no more than one (1) vote being cast with respect to any Lot. All lot owners shall abide by <br />the provisions of the By -Laws of the Association as well as Rules and Regulations of the <br />Association that may be amended and added to from time to time. <br />3. Each Owner of any Lot contained within the Properties agrees to this <br />DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />FOR GREENSTREET TOWNHOMES ASSOCIATION by acceptance of any conveyance of Lots <br />Seventeen (17) through Twenty (20), Thelen Subdivision, First Addition, Wood River, Hall <br />County, Nebraska whether or not it is so expressed in any such conveyance, and is deemed to <br />covenant and agree to pay to the Association regular annual maintenance assessments or charges <br />for the purposes set forth in Article III., Paragraph 4. hereof. <br />Such regular assessments, together with interest, costs and reasonable attorney's fees shall <br />be and constitute, from the date levied until paid, a lien upon such Lot against which such <br />assessment is made, without any requirement of recording further notice of such lien. <br />Such regular assessments, together with interest, costs and reasonable attorneys' fees shall <br />also be the personal obligation of each person who was an Owner of such Lot against which such <br />assessment is made at the time when such assessment was due. <br />All regular assessments shall be determined at a uniform rate for all Lots contained within <br />the Properties and collected on a monthly basis. <br />The Association shall fix the amount of any annual assessment in advance of each annual <br />meeting of the Association. The monthly due dates for payment of assessments shall be <br />determined by the Association. <br />Any interest not paid within thirty (30) days after the due date of such assessment shall <br />bear interest at the maximum rate allowed by law. <br />The Association may bring an action at law against any Owner of any Lot contained within <br />the Properties in the same manner as provided by law for foreclosure of mortgages. <br />Page 2 of 6 <br />
