Return to: <br />The Hoppe Law Firm <br />5631 S. 48th Street, Ste 220 <br />Lincoln, NE 68516 <br />nn <br />m <br />� I= <br />AMENDMENT TO PROTECTIVE COVENANTS <br />CONDITIONS & RESTRICTIONS <br />OF THE ORCHARD SUBDIVISION <br />11.77. <br />Ph <br />CD <br />THIS AMENDMENT TO PROTECTIVE COVENANTS is made the date hereinafter set <br />forth by THE ORCHARD, LLC, a Nebraska limited liability company ("Declarant"). <br />RECITALS <br />A. On July 23, 2019, a document entitled Declaration of Protective Covenants, Conditions <br />& Restrictions of The Orchard Subdivision (hereinafter the "Declaration") for The Orchard <br />Subdivision, Grand Island, Hall County, Nebraska, was recorded by Declarant, in the office of the <br />Register of Deeds of Hall County Nebraska as Instrument #201904287, for the "Neighborhood" or <br />"Property" legally described as follows: <br />The Orchard Subdivision, Grand Island, Hall County Nebraska, including Lots 1 <br />through 9 Block One, Lots 1 through 20 Block Two; Lots 1 through 8, Block Three; <br />Lots 1 through 28, Block 4; and Outlots A and B of such Subdivision as surveyed, <br />platted and recorded in Hall County, <br />Together with such additional property as may be subsequently added hereto by written <br />declaration of common grantor filed with the Register of Deeds of Hall County, Nebraska. <br />B. Article IX of the Declaration provides that for a period of twenty (20) years following <br />July 23, 2019, the Declarant shall have the sole, absolute and exclusive right to amend, modify or <br />supplement all or any portion of the Declaration. <br />NOW, THEREFORE, Declarant hereby declares that the Protective Covenants, Conditions <br />& Restrictions recorded on July 23, 2019 as Instrument #201904287, should be and hereby are <br />amended and restated in the following manner: <br />I. By deleting therefrom Article VIII Paragraph R and adding in its place and stead the <br />following: <br />R. Lot and Building Maintenance. Every Lot owner shall maintain his or her lot in a neat <br />and well manicured manner to a standard acceptable to the Declarant or, after transfer of <br />Declarant's Rights to the Association, to its Architectural Control Committee. Such <br />standard shall include regular mowing and keeping the lot free from debris, junk or other <br />unsightly material. Every building owner shall maintain each building including paint, <br />shingles or other exterior materials in a neat and presentable condition to a standard <br />acceptable to the Declarant or after transfer of Declarant's Rights to the Association or its <br />Architectural Control Committee.
