A: <br />x - : h <br />AWL <br />S <br />:. .; <br />Im <br />i <br />90 -10 ?142 <br />ORDINANCE NO. 1&,_ <br />AN ORDINANCE GOVERNING THE CUTTING AND REPAIR OF'SIDEWALKS <br />AND STREETS IN THE VILLAGE OF DONIPHAN. <br />BE IT ORDAINED BY THE CHAIRMAN AND THE BOARD OF TRUSTEES <br />OF THE VILLAGE OF OONIPHAN, NEBRASKA: <br />SECTION 1. "Pavement or sidewalk cut" defined. A pavement <br />or sidewalk cut for the purposes of Sections 2 to ..L —, inclusive, <br />shall be defined as any cut or opening made in any street, alley, <br />sidewalk or other public ground, and shall include all types <br />of street and alley surfaces and the curb and gutter. <br />SECTION 2. Applicability of Sections 3 to &. Work on <br />pavement or sidewalk cuts or openings made either as a result <br />of obtaining a permit for the same or as a .result of entering <br />into a contract with the village for some other type of construction <br />shall be subject to the provisions of Sections 3 to l4 , inclusive, <br />except that contracts with the village for the complete repaving <br />or resurfacing of an existing paved street or alley shall be <br />exempt from this provision. <br />sECTION 3. Permit to make sidewalk, etc. cut-required. It <br />shall be unlawful for any person to make any street, alley, side- <br />walk or other public ground cut or opening without first obtaininq <br />a permit to do so from the office of the village clerk. <br />SECTION 4. Permit: to whop issued. The following parties <br />shall be eligible to secure permits to cut or open streets, alleys, <br />sidewalks or other public grounds: <br />a. Public utility corporations. Any <br />public utility corporation having a <br />franchise to operate in any street, <br />alley or other public grounds in <br />the village. <br />b. Licensed plumbers. Lic-ens•ed plumbers <br />bonded by the village. <br />C. Others performing services. Others <br />performing services under contract <br />for the village with aL,, roved surety <br />bonds on file. <br />d. owners of real estate or their :.:•ents. <br />Any person owning real ostite cr their <br />agents, provided an appl;: �etion is filed <br />with th•a vzllaq•e clerk arJ approved <br />V <br />K <br />.s <br />
