<br />(1) family, nor shall any dwelling be used for occupancy of more than one (1) one family. No
<br />residential lot or Tots shall be divided or split to create smaller building areas, but residential
<br />lots may be combined, to establish larger building tots.
<br />2. Temporary Structures and other Prohibitions, No trailer, motor home, basement,
<br />tent, garage, shack, or other unsightly outbuilding shall be used in the subdivision as a dwelling
<br />at any time, nor shall any structure of a temporary character be used as a residence. No
<br />building or dwelling house shall be moved into the subdivision and placed upon a residential
<br />lot. No metal, plastic, or pre -fabricated style of storage sheds are permitted to be on any of
<br />the lots. All out buildings, and the location of same on a Lot must have prior approval by the
<br />architecture committee before construction. No walls will be approved which might result in
<br />a continuous wall around the lakeshore. No manufactured housing shall be allowed. No chain
<br />link fences of any type, excluding dog kennels made of chain link material, shall be allowed.
<br />No trampolines shall be permitted on any common areas. Trampolines on private property
<br />must be maintained in good condition. Liability for an and all damages and or injuries due
<br />to the trampoline, lie with the owner of the property and the HOA will be held harmless.
<br />Derelict trampolines must be removed from the property and disposed of properly. No
<br />mercury or sodium vapor lights are allowed on any lot. Street lighting that may be installed
<br />by the county or the association is exempted from all lighting restrictions.
<br />3. Use ofStoraae, No unused or discarded building materials, junk or rubbish shall be
<br />left exposed on any lot. No worn out or discarded automobiles, machinery or parts thereof
<br />shall be stored on any lot in the subdivision. No portion of any lot in the subdivision shall be
<br />used for junk piles, storage of unlicensed or derelict vehicles, or the storage of any kind of
<br />junk, waste, or other unsightly materials.
<br />4. Architectural Control. The Board of Directors of the Amick Acres West
<br />Homeowners Association, Inc., or such committee the Board may create for purposes of
<br />architectural review and approval, shall have the responsibility for approving all
<br />construction upon the lots. Construction shall include, but not be limited to dwellings,
<br />outbuildings, boat docks, boat ramps, sea walls, yard walls and fences, and all site drainage.
<br />The review and the approval of any construction on a Lot shall require written approval
<br />of the plans and specifications showing the nature, kind, shape, height, materials and
<br />location of the construction and shall be submitted to and approved in writing as to the
<br />harmony of external design and location in relation to the surrounding structures, Lots and
<br />topography by the Architectural Committee. The Architectural Committee shall also review
<br />such plans and specifications in relation to the type and exterior of improvements
<br />constructed, or approved for construction, on neighboring Lots and in the surrounding
<br />area. The decision to approve or refuse approval of a proposed construction shall be
<br />exercised by the Architectural Committee to promote development of the Lots and to
<br />protect the value, character, and residential quality of all Lots. If a determination is made
<br />that the proposed construction will not protect and enhance the integrity and character of
<br />alt of the Lots and neighboring Lots as a quality residential community, the Architectural
<br />Committee may refuse approval of the proposed construction.
<br />Prior to the start of actual construction of any project, the homeowner, or the general
<br />contractor for the homeowner, shall submit to the Board of Directors or its designated
<br />committee, a site plan for the proposed dwelling, outbuilding, or other construction on the
<br />tot. For dwellings, the drawings or blueprints shall show the exterior design and elevations
<br />of all sides of the home.
<br />In reviewing the plans for dwellings, the Board of Directors, or its designated committee,
<br />shall confine its review to the site plan and placement of the dwelling unit and/or outbuilding
<br />on the lot, elevation of the buildings relative to adjacent properties, setback requirements,
<br />driveways, the location of the well and septic systems", and the compatibility of color and
