202100148 <br />02 degrees 42 minutes 30 seconds West a distance of 195.60 feet to a point on the <br />Southerly Right of Way line of the BNSF Railroad said point also being the Point <br />of Beginning; thence South 10 degrees 51 minutes 20 seconds West a distance of <br />78.30 feet; thence North 63 degrees 06 minutes 20 seconds West a distance of <br />362.66 feet to a point on the centerline of the present channel of Wood River; <br />thence North 50 degrees 33 minutes 00 seconds East along said centerline channel <br />a distance of 42.33 feet; thence North 65 degrees 21 minutes 40 seconds East <br />along said centerline channel a distance of 33.28 feet; thence North 84 degrees 45 <br />minutes 20 second East along said centerline channel a distance of 19.57 feet to a <br />point on the Southerly Right of Way line of the BNSF Railroad; thence south 63 <br />degrees 06 minutes 30 seconds East along said Right of Way line a distance of <br />286.76 feet to the Point of Beginning. <br />CERTIFICATION OF TRUST <br />GLENN R. WILSON, JR. and CONSTANCE S. WILSON, being first duly sworn upon <br />oath, depose and state that: <br />1. Glenn R. Wilson, Jr. created the Glenn R. Wilson, Jr. Trust dated July 28, 1988 <br />(the "Trust") wherein he designated himself and his spouse, Constance S. Wilson as the initial <br />Co -Trustees of the Trust; <br />2. From the date of the creation of the Trust Affiants have served as Co -Trustees of <br />the Trust and the Trust grants Affiants as Trustees all powers under the Nebraska Uniform Trust <br />Code; <br />3. The Trust has been funded by the transfer of real estate to the Trust. To clarify <br />the ownership of such real estate, any property held, registered or owned in any of the following <br />forms or in any similar manner or abbreviations thereof wherein from the registration or own- <br />ership of such property it is apparent that it is intended such property is to be part of the trust <br />estate: <br />Glenn R. Wilson, Jr. Trust; <br />Glenn R. Wilson, Jr. & Constance S. Wilson, Co -Trustees of the <br />Glenn R. Wilson, Jr. Tr., and <br />Glenn R. Wilson, Jr. and Constance S. Wilson, Co -Trustees of the <br />Glenn R. Wilson, Jr. Trust dated July 28, 1988, <br />shall be considered as properly registered for purposes of making such property a part of said <br />Trust. Any designation of legal sufficiency for title purposes are acceptable to any interested <br />party or otherwise adequately descriptive of the Trust shall be sufficient to accomplish transfer to <br />or from the Trust. <br />4. Affiants are the beneficiaries of the Trust during their lifetimes and the remainder <br />beneficiaries are Judith Lynn Wiegert, Glenn Richard Wilson, III, Sherry A. Carson Schuester <br />and Wade King Wilson. <br />5. The Trust Agreement has not been revoked or amended to make any representa- <br />tion contained in this Certification of Trust incorrect and the signature of Affiants are as the Co - <br />Trustees under the terms of the Trust Agreement. <br />5 <br />
