�.�- �aoss� <br /> 2. TITL . Trustor is the awner of the �rop�rty and has the right and author'srr <br /> to execute this Deed of T�ust in respect to,the property. � <br /> 3. TAXES AND ASSESSMENTS. Trustor shall pay,when due, each ins'rallment <br /> of all taxes and special assessments of every kind, naw or hereafter levied a�ainst the <br /> Trust Estate or any part thereof, before delinquency, without notice or deman�, and shall <br /> provide Beneficiary with evidence of the payment o� th� same, and, in the ewent <br /> Beneficiary shall so requsre, to add to the payments required under the Deed of Trust Note <br /> secured here�y, such amount as may be sufficient to enable the Beneficiary to pay such <br /> taxes, assessments, or other charges as they may ber,ome due. Trustor shall pay all taxes <br /> and assessments which may be levied upon Beneficiary's interest herein or upon this Deed <br /> of Trust or the debt securec! hereby, without regard to any law that may be enacted <br /> imposing payment of the whole or any part thereof upon the Beneficiary. <br /> 4. REPAIR. MAINTENANCE. AND USE. To not commit waste on or damage <br /> the property and to use due carn to prevent others from so doing; to keep the house and <br /> irrigafrcn zqu'rpmertt sif�rafed' trpor�t�aforecl�sc�ed re�a!�staf� ir�gaad canditYrsn► and <br /> repair; to keep the property free frcm mec�ar�ics or other liens not expressly subordinated <br /> to the lien hereof; to not make, suffer, or permit any nuisance to exist nor to diminish or <br /> impair the value of fh� pr�perty by any act or omission to act; and to con��ply with all <br /> requirement� of law with respect to the property. <br /> 5. INSURAKCE. At all times during the term hereof to keep the Property <br /> insured against damage by fire, h�zards included within the term"extended coverag�:,"and • <br /> such ather hazards as Beneficiary may require, in an amourrt of not less thai� the �� - <br /> replacement value thereof and with companies acceptable to Beneficiary, inciudi�g_a <br /> standard mortgagee clause with loss payable to the �eneficiary and containing an <br /> additional provision that the policy cannot be canceled without prior written notice to the <br /> Benefciary. In case of loss under such policies, the Beneficiary is authorized to adjust, <br /> collect, and compromise all claims thereunder and shalt have the optbn of appiying all or <br /> part of the insurance proceeds (a)to any indebtedness secured hereby and in such order <br /> as Beneficiary may determine, (b) to the Trustor to be used for th�e repair or restoratian of <br /> the Property ar (c) for any other purpose or abject satisfactory to Beneficiary without <br /> affecting the Ilen of this Deed af Trust for the full amount secured hereby before such <br /> payment ever took place. Any application of proceeds to indebtedness shall not extend <br /> or postpone the due date of any� payments under the Deed of Trust Note, ar cure any <br /> default thereunder or hereunder. <br /> 6. ACTIONS AFFECTING TRUST ESTATE. Trustor shall appear in and <br /> contest any action or procee�ing purporting to affect the security hereof or the rights or <br /> powers of Beneficiary or Trustee, and shall pay all costs and expen�es, including cost of <br /> evidence of titie and attomeys fees, in any such action or proceeding in which Beneficiary <br /> or Trustee may appear. Should Trustor fai(to make any paymen# or to do any act as and <br /> in the manner p�ovided in any of the Loan Instruments, Beneficiary and/or Trustee, each <br /> in its own discretion, withoiat abligation so to do and without notice to or demand upon <br /> Trustar and without releasing Trustor from any obligation, may make or do th� same in <br /> such rnanner and to such extent as either may deem necessary to protect the security <br /> hereof. Trustor shall, immediately upon demand therefor by Beneficiary, pay all costs and <br /> expenses incurred by Beneficiary in connection with the exercise by Beneficiary of the <br /> foregoing rigf�t�, including wothout limitation costs of evidence of title, Court costs, <br /> appr�is�ls, surveys and attarneys fees. Any such costs and �xpenses n�t paid withi� ten <br /> (10) days of written demand shall draw interest at the default rate provided in the Note. <br /> '. EMINENT DOMAIN. Should the Trust Estate, or any part thereof or inte�est <br /> therein, be taken or damaged by reason of any public improvement or condemnation <br /> proceeding, or in any other manner including deed in lieu of Condemnatinn <br /> ("Condemnation"), or should Trustor receiv�any notice or other information regarding such <br /> proceeding, Trustor shalf give prompt written notice thereof to Beneficiary. Beneficiary <br /> shall be entitled to the extent of bensflclary's Interest in the subject real est�te, to all <br /> compensation, awards and other payments or relief th�refor, and shall be entitled at its <br /> option to cor�mence, appear in and prosecute in its own name any action or proceedings, <br /> BQneficiary shalf �Iso be entitled to make any compromise or settlement in connec4ion with <br /> such taking or damage.
