area. <br />242008126 <br />2. WATER SANITARY SEWER. Subdivider will connect to all public water and sewer <br />mains if such lie within 300 feet of the property line of a lot created with such tract of land and waive <br />any objection to the creation of any water or sewer improvements. Subdivider will pay for any water <br />main or sewer main extensions deemed necessary to provide adequate service as determined by the <br />City Engineer for the Village. <br />3. DRAINAGE. The Subdivider agrees to create the lots in the subdivision and in <br />conjunction with the construction of the structures thereon, so that storm water drains to the public <br />right-of-way bordering Highway 281. <br />4. PROPERTY TO BE ANNEXED. It is the intention, by this Agreement or approval of <br />the subdivision, of the Village of Doniphan to annex the above described property into the Village <br />of Doniphan. <br />5. WARRANTY. The undersigned owner, as Subdivider, warrants that he is the owner in <br />fee simple of the land described and proposed to be known as Crane -View Third Subdivision, an <br />addition to the Village of Doniphan, Hall County, Nebraska, and that an abstract of title will be <br />submitted for examination, if necessary, upon request of the Village of Doniphan. This Agreement <br />shall run with the land and shall be binding upon an inure to the benefits of the parties, their <br />successors, assigns, heirs, devisees, and legatees. Where the term Subdivider is used in this <br />Agreement, the subsequent owners of any lot in the subdivision shall be responsible to perform any <br />of the conditions of this Agreement if the Subdivider has not performed such conditions.
