200108783 <br />6. Flood Plain. Since the subdivision is within a delineated flood plain, all <br />structures constructed shall have the lowest floor elevation to a minimum of one foot above the <br />elevation of the 100 -year flood as determined by the building permit received by the Subdivider or <br />successors from the Building Department under the provisions of Section 2- 1506.06, R.R.S. 1943. <br />No basement shall be constructed in connection with any structure in the flood plain unless such <br />basement is floodproofed and certified as such by a qualified engineer or architect. <br />7. Landscaping. The Subdivider agrees to comply with the requirements of the <br />Landscaping Regulations of the City of Grand Island, and plans as submitted to and approved by the <br />City's Building Department. <br />8. Lot Three (3) and Four (4) Requirements. Lots Three (3) and Four (4) of <br />this subdivision are located within a residential development zone. For this reason, the following <br />requirements will apply to Lots Three (3) and Four (4) only, and are in addition to those requirements <br />specified in this agreement. <br />(A) Pavin : The Subdivider agrees to pave and maintain Lakeview Circle as a private <br />road allowing public ingress and egress to, from and through the property. The Subdivider <br />also agrees not to request that the City of Grand Island undertake maintenance or <br />responsibility of Lakeview Circle unless the road is improved to City standards in place at <br />the time the request and right -of -way is dedicated to and accepted by the City of Grand <br />Island. The Subdivider agrees to grade and surface those portions of Lakeview Circle located <br />on Lot Four (4) with gravel or similar material during the initial phase of construction to <br />allow emergency access through and around the development. <br />
