20200427'7 In addition, the Buyer agrees to defend, indemnify and hold harmless the Sellers and subsequent owners of the Lower Estate Property from and against any and all liabilities, claims, damages, penalties, expenditures, losses or charges (including, but not limited to, all costs of investigation, monitoring, legal fees, remedial response, removal, restoration or permit acquisition) which may now or in the future, be undertaken, suffered, paid, awarded, assessed, or otherwise incurred as a result of the construction of the drainage ditch on the Subject Property or the altering of the natural course of the contour of the Subject Property at the point at which water exits the Subject Property. The provisions of this Paragraph 4 shall commence upon the Buyer's possession of the Subject Property as provided at Paragraph 7 hereinbelow, survive the closing of this transaction, and shall run with land for the benefit of the Sellers and subsequent owners of the Lower Estate Property. Upon the closing of this transaction, the Buyer agrees to execute a Notice, in recordable form, that outlines the provisions of this Paragraph, which Notice the Sellers may record at the Sellers' expense.
