20200427'7 <br />In addition, the Buyer agrees to defend, indemnify and hold harmless the <br />Sellers and subsequent owners of the Lower Estate Property from and against any <br />and all liabilities, claims, damages, penalties, expenditures, losses or charges <br />(including, but not limited to, all costs of investigation, monitoring, legal fees, <br />remedial response, removal, restoration or permit acquisition) which may now or <br />in the future, be undertaken, suffered, paid, awarded, assessed, or otherwise <br />incurred as a result of the construction of the drainage ditch on the Subject <br />Property or the altering of the natural course of the contour of the Subject <br />Property at the point at which water exits the Subject Property. <br />The provisions of this Paragraph 4 shall commence upon the Buyer's possession <br />of the Subject Property as provided at Paragraph 7 hereinbelow, survive the closing of <br />this transaction, and shall run with land for the benefit of the Sellers and subsequent <br />owners of the Lower Estate Property.
