Lautenschlager Family Trust created under ARTICLE VIII, Paragraph B. of the Norman W. Lautenschlager Revocable Trust Agreement dated February 1, 1994 and Myron Lautenschlager and Karen L. Kissinger, Co - Trustees of the Second Amendment and Restatement of Coralee I. Lautenschlager Revocable Living Trust dated November 23, 2005, as amended, ("Sellers") and Amick Acres East Homeowners Association, Inc., a Nebraska non-profit corporation, ("Buyer") entered into a certain Agreement for Sale and Purchase of Real Estate dated December 24, 2019 (the "Purchase Agreement") for the sale and purchase of Lot One (1), Amick Acres East Second Subdivision, Hall County, Nebraska (the "Subject Property"); and (b) Paragraph 4 of the Purchase Agreement reads, in its entirety, as follows: 4. The Buyer hereby discloses that it is purchasing the Subject Property for the purposes of constructing a drainage ditch thereon. The Buyer further discloses that the construction of the drainage ditch on the Subject Property will alter the natural course of the contour of the Subject Property at the point at which water exits the Subject Property.
