Lautenschlager Family Trust <br />created under ARTICLE VIII, Paragraph B. of the Norman W. Lautenschlager Revocable Trust <br />Agreement dated February 1, 1994 and Myron Lautenschlager and Karen L. Kissinger, Co - <br />Trustees of the Second Amendment and Restatement of Coralee I. Lautenschlager Revocable <br />Living Trust dated November 23, 2005, as amended, ("Sellers") and Amick Acres East <br />Homeowners Association, Inc., a Nebraska non-profit corporation, ("Buyer") entered into a <br />certain Agreement for Sale and Purchase of Real Estate dated December 24, 2019 (the "Purchase <br />Agreement") for the sale and purchase of Lot One (1), Amick Acres East Second Subdivision, <br />Hall County, Nebraska (the "Subject Property"); and <br />(b) Paragraph 4 of the Purchase Agreement reads, in its entirety, as follows: <br />4. The Buyer hereby discloses that it is purchasing the Subject Property for <br />the purposes of constructing a drainage ditch thereon. The Buyer further discloses that <br />the construction of the drainage ditch on the Subject Property will alter the natural course <br />of the contour of the Subject Property at the point at which water exits the Subject <br />Property. As such, the Buyer hereby agrees to pay for any and all damages of any kind <br />sustained by or to the following described real estate as a result of altering of the natural <br />course of the contour of the Subject Property at the point at which water exits the Subject <br />Property: <br />East Half of the Southeast Quarter (E'/2SE'/4) of Section Two (2), Township Nine <br />(9) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska, <br />excepting therefrom the Subject Property (the "Lower Estate Property"). <br />1 <br />0, 3, 6D <br />
