202002679 <br />5.5 Sunscreens. <br />DRC approval is not required for sunscreens, provided that the frames are the color of the <br />body of the Residence and the screen color is black, dark brown, or charcoal. <br />5.6 Rain Gutters. <br />Rain gutters must be added to Residences to prevent erosion of landscaped areas. All gutter <br />installations must be configured to an appropriate roof drainage plan for the specific Residence <br />and elevations. In addition, they must blend or match the body color of the home where attached. <br />Drainage shall not be discharged onto adjacent Lots. <br />5.7 Skylights; Solar Tubes. <br />Skylights and solar tubes will be considered for approval by the DRC if they are installed <br />on the rear side of the Residence and screened from street view. <br />5.8 Fences. <br />Vinyl fences are permitted, subject to the terms and conditions approved by the DRC. No <br />Owner shall construct a fence on his Lot without prior written approval of the DRC, and no fence <br />shall be approved by the DRC unless such fence has a gate or other reasonable means of ingress <br />and egress for utility companies to install, maintain, repair, and replace utilities (including but not <br />limited to electricity, gas, water, sewer, cable, and telephone) servicing the Owner's Lot. Once <br />any fence has been erected, the Owner shall maintain the same in good condition and repair and <br />in a condition that allows such reasonable means of ingress and egress. <br />5.9 Pools and Spas. <br />(a) In addition to DRC approval and compliance with the requirements set forth on <br />Exhibit D to this Declaration, all pools and spas must be installed according to local <br />and/or state law and will require protective fencing and be subject to certain <br />setbacks. <br />(b) The location and screening of, and sound -insulating materials for, pool pumps and <br />other equipment shall be subject to prior approval of the DRC. The open end of <br />the screen wall will require a gate, landscaping, or return wall to ensure the <br />equipment is not Visible From Neighboring Property. All screening shall match as <br />closely as possible the color and materials of the Residence, to give the appearance <br />of being an integral part of the architecture of the Residence. <br />(c) Above -ground pools, spas, or hot tubs are permitted on Improved Lots upon <br />approval by the DRC but may not be installed outside the side footprint of the <br />Residence. <br />(d) Pools may not be backwashed into washes, Common Areas, drainage ways, or <br />streets. All backwash water must be contained on the Owner's Lot. <br />5.10 Holiday Decorations. <br />Winter holiday decorations may be displayed from November 1 st to January 31St. All other <br />holiday decorations may be displayed no sooner than seven (7) days prior to the holiday and must <br />be removed within seven (7) days after the holiday. <br />ARTICLE 6 <br />EASEMENTS <br />6.1 Easements for Use of Common Area. <br />Every Owner and Resident, together with their family members, guests, and invitees, shall <br />have a right and easement of enjoyment in and to the Common Area, which right shall be <br />appurtenant to and shall pass with the title to every Lot, subject to: <br />(a) The right of the Association to dedicate, convey, transfer, lease, or encumber the <br />Common Area as provided in Section 7.16; provided, however, that if access to a <br />Page 27 of 52 <br />
