<br /> d. The C3rantee agroes that in the event the(3rantor lake suffers environmental damage
<br /> or contamination from inflow of surface waters from Grantee's drainage sources,the(irantee will
<br /> hold the Grantor harmless. If the U.S.Environmental Protection Agency (USEPA)or Nebraska
<br /> Tkpartment of Envirorunental Qualiry(NDEQ)cktermines that environmental damage has occumed
<br /> from such inflow,the Grantee will clean the lake and its�vaters in accordAnce with sucli remec�iation
<br /> plan es is required and approved by the USEPA or NDF,Q. ,
<br /> e. In i'urtherance of the intensts of the Grantee and Gruntor a� expnssed in this
<br /> Drainage Easemcnt the Grantee shall perform tests of the water samplcs from Finthome Lake and
<br /> Vanosdall Lake four times each year in the laboratory at the Grantees' WRSte Water Tnatment Plant
<br /> to monitor water quality.Additional tests shall be done upon the requesk of the Grantor or the
<br /> desxgnated homeowner's association for Vanosdall Lake or 1�irethorne Lake in the event there is
<br /> cause ta believe contaminants have entered either lake frona inflow of surface waters from the
<br /> Grantee's drainag�sources.
<br /> f. The Grantee shall install, inspect, maintain, repair and clean tra.9h grates in the
<br /> drainage inlet into Vanosdall Lake w prevent the introduction of garbage,trash end junk from inflow
<br /> of waters through the storm water scwer system.The Grantee shall install a iish screen between the
<br /> Wood River and Firethorne Lake to prohibit fish travelin.g betwecn either body of water. 'fhe
<br /> CTrantor or the homeowners' association for Firethorne Lake shall inspect, rnaintain and clean the
<br /> fish screen as needed to insure its continued successful operation.
<br /> The Grantor and Grantee covenant and agi�ee that this drainage�sement shall remain in full
<br /> force and effect in perpetuity or until such time as it is mutually terminated by 4he parties and that
<br /> tecros and condirions set forth above shall run with the land and be binding on the parties'successors
<br /> and assigns.
