<br /> DRAINAGE EASEMENT AGREEMENT ��
<br /> The widersigned,VANOSDALL SOFTBALL FIELDS,INC.(Grantor),in consideration of
<br /> ONE DOLLAR(51.00)AND OTHER VALUABLE CONSIDERATION paid,receipt of which is
<br /> hereby acknowledge, does hereby grant, bargain, $ell and convey to the CITY OF GRAND
<br /> ISLAND,NEBRASKA,a Municipal Corporation(Grantee),a permanent and perpetual easement
<br /> for drainage,flood control,storage,monitoring and testing of surface waters in the drainage inlei snd
<br />- oudet and the lake known as Vanosdall Lake located on the tract of land described in Exhibit A
<br /> attached hereto and made a paat hereof by reference.
<br /> The drainage easement granted herein to the City of Grand Island shall be subject to the
<br /> following mutual times and conditions:
<br /> a. The Graz►tor reserves the right to use the tract of real estate described in Exhibit A
<br /> including the waters located thereon,in any ma�er no3 inconsistent with or in derogation of the
<br /> drainage easement conveyed herein to the Grantee and may enlarge or reconfigure the lake located
<br /> on the Grrantor's real estr�te as the Grac►tor may deem necessary and prudent.
<br /> b. 'The Grantee may introduce waters into the lake through either the facilities draicu�ge
<br /> existing at the tirne of this convayance�r by means of an undergrownd conduit from the right-of-way
<br /> for Highway 34.The source of the Waters subject to this drainage easement shall be limited to the
<br /> lands shown on diagrs+m E�chibit"B"attached hereto and made u part hereof. _
<br /> - c. The City shell provide an outlet from the Grantor's lake into the lake known as
<br /> - Firexhome Lake. The surFace elevation of the autlet shall be sut�"iciently low to prevent flood
<br /> _ damage to the Grantor's currently existing buildings,fixtures and improvements.
