<br /> to entez the lake. The mecha�nical gatt wil!be ope�atod by the City or a h�meowners essociation for
<br /> the property owners on Firothorne Lake,W drain Firethome Lake into the Wood River.
<br /> d. The Crantce agroes that in the avent the Granw�'s take suffers�cnvironmental damage
<br /> or contaminadon from inflow of surfacc waters from Grantee's drainage sources,the Grantee wiU
<br /> hold the Gcantor l�acmless. If the U.S. Erevironmental Protection Ageney (USEPA)ur Nebraska
<br /> Deparhx►ent of Environmental Quality(NDEQ)determines thet znvironmental damage has occurnd
<br /> from such in#low,the Grantee will clean the lake and its�vatc�s in accordance with such remediation�
<br /> plen as ys required and approvod by the USEPA or NDEQ.
<br /> c. Infiutheranoe of trie intarsts of the Granta and Grantor as expressed in this Drainago
<br /> F.ASement the Grantee shall perfonn tests of the water sarnples from Firethorne L�Ice and Venosdall
<br /> Lake four times each year in the laboratory at the Grantors'Wastc Water TceaUntnt Plant to monitor
<br /> w�ater quality. Additional tcsts shall be don� upon thc rcqoest af the Grantor or the designated
<br /> homoowner's essociation for Vanosdall Lake or Firetlwmt Lake in the event there is cause W beliCVe
<br /> contaminants have entered either lake from inflow of surface waters from the Grantee'�drainage
<br /> sourccs.
<br /> f. The Crantee shall install, inspect, maintain, repair and clean trash grates in t�e
<br /> drainage inlet into Vanosdall Lak�to pr�vent the intrnduction of gacbnge,trash and junk fxom inflow
<br /> of waters through thc storm water sewer system.The Grantee shall install a fish screen betwern the
<br /> Wood River and Firethome Lalce to prohibii fish traveling betwan either body of water. 'i'he
<br /> Grantor or the homeowner's es.sociation for Finthome Lalce shall insnect maintain and clean the
<br /> fish xran as nceded ta insure its continued succcssful aparation. �
<br /> 'I't�Grantors and Grantee covenant and agree that this Drainage Easement Agrc�ment shall
<br /> rtmain in full Torce and effect in perpetuity or until such time as it is mutually terminated by the
<br /> parties and that terms and aonditions stt forth above shall run with the land end ba binding on the
<br /> parties peisonal rcpresentatives,heirs,successors and assigns.
