202001655 <br />(g) No offensive or unsightly appearance shall be maintained or allowed to <br />exist upon any Lot, nor shall any trash, ashes or other refuse be thrown, placed, or <br />dumped upon any Lot. The Association shall have the right to require all Lot Owners to <br />place trash and garbage in containers to facilitate their removal. All rubbish, trash, <br />garbage, tree branches, and yard waste shall be regularly removed from the premises and <br />shall not be allowed to accumulate thereon. <br />(h) No machinery or equipment of any kind shall be placed, operated or <br />maintained upon any Lot, except such machinery or equipment as is usual and customary <br />in connection with ownership and maintenance of any Lot. <br />(i) No improper, offensive, or unlawful use shall be made on any Lot. All <br />valid laws, zoning ordinances, and regulations of all government bodies having <br />jurisdiction over the Subdivisions shall be observed. Any violation of such laws, zoning <br />ordinances or regulations shall be a violation of these Covenants. <br />(j) All new construction and/or remodeling of any existing structure on any <br />Lot shall meet or exceed the requirements of the Nebraska Builders Code (NBC --2012), <br />and the Nebraska Electrical Code (NEE --2017), or any updates thereof. If needed, it shall <br />be the duty of the homeowner to obtain a building permit from the Hall County Building <br />Inspector prior to the start of any new construction and/or remodeling project. The <br />exterior of any outbuildings should match or complement the existing colors and siding <br />of the house. Any remodelling of additions must be of the same or better quality and <br />appearance of the original structure(s). Once started, all exterior work should be <br />completed in a reasonable and timely manner. <br />(k) No dead, diseased, or potentially dangerous trees shall be allowed to <br />remain on any Lot. No portion of any lot shall be used for the piling of dead trees, <br />branches, bushes, grass clippings, or any other yard waste. <br />3. Lake Usage. The owner of any lot in the subdivision agrees to use the Lake Lots, <br />or common areas (Lot 37 -Amick Acres Subdivision, and Lot 24 Amick Acres 2nd <br />Subdivision) in such a manner as not to interfere with the use of the lake by any other <br />owner or in such manner as to create a nuisance, annoyance, or unlawful disturbance. <br />The owners of all Lots shall be responsible for the conduct and safety of their guests. <br />All Lot owners and occupants of the Amick Acres Subdivision and the Amick <br />Acres 2nd Subdivision acknowledge that the Lake Lots are potentially dangerous and <br />there shall be no liability of any kind upon Renee J. Amick, John W. Amick, or the <br />Homeowners Association. The use of the Lake Lots by any Lot owner and their guest(s), <br />shall be at the sole risk of the owner and guest(s) of the owner. The use of Lake Lots <br />shall be restricted to owners of Lots, and their guests. <br />The Lake shall be deemed a "no wake" lake. <br />4. Taxes. Any real estate taxes levied and assessed against the Amick Acres <br />Homeowners Association shall be borne equally and paid by the members of the Amick <br />Acres Homeowners Association through the annual assessments as described Article III., <br />paragraph 4. <br />
