"First Party" is the owner of Lot 2 and Lot 3, King's Crossing Subdivision in the City of <br />Grand Island, Hall County, Nebraska ("Lot 2" and "Lot 3" respectively). <br />B. "Second Party" is the owner of Lot 1, King's Crossing Subdivision in the City of Grand <br />Island, Hall County, Nebraska (the "Lot 1"). <br />C. A proposed roadway and utility easement is shown on Exhibit "A" attached hereto and <br />incorporated herein by this reference, which is the Final Plat of King's Crossing <br />Subdivision, An Addition to the City of Grand Island, Hall County, Nebraska, hereinafter <br />"Subdivision." The Proposed roadway runs across a portion of "Lot 1." <br />D. "First Party" and "Second Party", by this instrument, intend to create a non-exclusive <br />easement of right-of-way for ingress and egress over that portion of the Subdivision <br />described herein (the "Easement Area") for the benefit of "First Party" and "Second Party" <br />according to the terms and conditions set forth herein. <br />AGREEMENT <br />For and in consideration of the mutual promises hereinafter set forth and other good and <br />valuable consideration, the receipt and sufficiency of which are hereby acknowledged, and <br />intending to be legally bound, the parties hereby agree and covenant with each other, as follows: <br />1. Easement Area. The term "Easement Area" shall mean A TRACT OF <br />LAND CONSISTING OF PART OF LOT 1 OF KING'S CROSSING SUBDIVISION <br />IN THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA AND MORE <br />PARTICULARLY DESCRIBED AS FOLLOWS: <br />COMMENCING AT A NORTHERLY CORNER OF SAID LOT 1, SAID POINT <br />ALSO BEING ON THE SOUTH RIGHT-OF-WAY (R.O.W.)
