201904287 <br />ARTICLE II <br />Annexation of Additional Property <br />As long as there is a Class A-2, B-2 or C-2 membership, Developer may, by instrument duly <br />executed by it, and recorded, add additional land to the property, and additional unencumbered <br />property to the Common Area, and no consent or approval of other members of the Association shall <br />be required, provided however, that the added property and Common Area is finally platted in <br />conformance with the Community Unit Plan for the Neighborhood now on file with the City of <br />Grand Island. Additional property and Common Area not within the forgoing provisions or as <br />described in Article I paragraph A may be annexed only with the consent of two-thirds (2/3) of each <br />class of members. <br />These covenants may be incorporated by reference to their filing number to impose them <br />upon any additional property or subsequently filed final plat. <br />ARTICLE III <br />THE ASSOCIATION <br />A. Organization <br />Declarant shall cause the incorporation of the Association. The Association shall have as its <br />purpose the promotion of the health, safety, recreation, welfare and enjoyment of the residents of the <br />Residential Property, including: <br />1. The acquisition, construction, improvement, maintenance, operation, repair, upkeep, <br />replacement and administration of the Lots and Common Area for the use, benefit and enjoyment of <br />all the Members and Residents. <br />2. The promulgation, enactment, amendment and enforcement of rules and regulations <br />relating to the use and enjoyment of the Commons. The rules and regulations may permit or restrict <br />use of the Commons by Members, their families, their guests, the Residents and/or by other persons, <br />who may be required to pay a fee or other charge in connection with the use or enjoyment of the <br />Commons, provided, however, such rules or regulations shall not unfairly discriminate against any <br />class of residents on the Property. <br />3. The exercise, promotion, enhancement and protection of the privileges and interests of the <br />Residents of The Orchard, the protection and maintenance of the residential character of the <br />Residential Property, and the protection and maintenance of the remaining property of the <br />Subdivision. <br />B. Membership and Organization of the Association <br />Every person or entity who is a record owner of a fee or undivided fee interest in any Lot <br />which has been final platted and which is subject to the terms of this instrument shall be a member of <br />the Association, including contract sellers, but not including persons or entities who hold an interest <br />4 <br />
